Ergänzend zum vorherigen Post. Seit 10 Monaten konnte AEG keine Termine mit Randy und Jermaine bekommen oder sie wurden von diesen gecancelt. Hierzu fand bereits eine Anhörung am 5. Oktober statt und das Gericht ordnete die Anhörungen für den 26. Oktober an.

In Blümchen Post beruft sich die Bild auf News of the World,was man von dem Blättchen halten soll, wissen wir nun alle (zum Glück gibt es das nicht mehr) und dieses Foto ist nie und nimmer in einem Londoner Hotel geschossen worden.

Gegenantrag AEG

Zusammenfassung IVY/MJJC:

I still can't see documents filed by KJ side but from AEG documents it can be understood that they filed declarations saying they didn't leak the documents / emails. KJ's lawyers then blame multiple parties - initially Lloyds , then Mann acted alone, a secret criminal that broke into lawyers offices and took the documents , a rogue contract attorney, AEG's lawyers and leak before confidentiality agreement was signed etc.

Ich habe keine Einsicht in die von KJs Seite gestellten Anträge, aber was man aus den AEG-Dokumenten ersehen kann, hat man anscheinend erklärt, dass sie nicht diejenigen seien, die die Dokumente/Emails an die Presse gegeben hätten. KJs Anwälte verdächtigen verschiedene Parteien -zuerst Lloyds- dann H. Mann, der alles alleine machte, einen unbekannten Kriminellen, der in das Anwaltsbüro eingebrochen u. die Dokumente entwendet haben soll, einen skrupellosen Vertrags-Anwalt, AEGs Anwälte usw.

Lloyds is cleared as they didn't have access to all documents, neither did AEG lawyers some documents were only provided to KJ's lawyers, document production only started was after confidentiality agreement, Mann couldn't have done this alone as he didn't have access to those either. A secret criminal wouldn't have access to the stamped docs too. No contract attorney had access to those documents either.


Mann is caught because 1 day before the article he sends an email to Lloyds lawyers saying he's the source and look out for the article about AEG. Mann later call his email stupid and his actions stupidity that started all this.

KJ's lawyers asked AEG to withdraw their motion stating that they didn't have the "smoking gun" and they can't blame KJ as there could be many other possible scenarios- AEG refused. KJ's lawyer now asking sanctions against AEG. AEG is firm in their position that there could be no other possible scenarios, Mann couldn't acted alone and he's too connected to Katherine to be considered a third party.

KJs Anwälte haben AEG gebeten ihren Antrag zurückzuziehen, da sie keine eindeutigen Beweise hätten u. sie nicht KJ für die Leaks verantwortlich machen könnten. Es gäbe viele andere mögliche Szenarien. AEG lehnte ab.
Nun beantragen KJs Anwälte Sanktionen gegen AEG. AEG bleibt standhaft in ihrer Position, dass es eben keine anderen Szenarien geben könne. Mann konnte nicht alleine agieren u. sei zu eng mit Katherine, so dass man sich eine 3. Partei nicht vorstellen könne.

AEG hired a forensic expert for the documents, who determined that Ortega documents came from the copies given to KJ's lawyers for certain. Even though Ortega gave the same documents to Lloyds, AEG and KJ's lawyers, Lloyds documents had a large confidential mark over them (like how we do with documents), the copies didn't have those. The copies given to KJ's lawyers and AEG's lawyers were hand stamped which meant the confidential stamps were at different locations. It was a perfect match to the copies given to KJ.

The leaked AEG Live emails also had the same copier marks (a ghost line on the right side of the paper) as KJ's lawyers printer. So the forensic expert says he believes those leaked AEG emails were copied / printed at KJ's lawyers office. Confidential stamps were cut. (He can't say for sure because he didn't have access to the copier / printer machine)

AEG hat einen Forensik-Experten angeheuert, der feststellte, dass die geleakten Ortega Mails ganz sicher von den Kopien stammen, die KJs Anwälten besitzen. Auch wenn Ortega die gleichen Dokumente an Lloyds, AEG u. KJs Anwälte gab, Lloyds Unterlagen sind alle mit einem großen Vertraulichkeitsvermerk versehen, und die an die Presse gegangen Kopien haben keine Markierungen.
Die an KJsAnwälte u. AEG gegangenen Kopien wurden per Hand abgestempelt, was bedeutet ,dass die Stempel alle an unterschiedlichen Stellen sind. Hier ist eine totale Übereinstimmung mit den Dokumenten , die KJs Anwälte bekommen haben.

Dei geleakten AEG Live mails haben die gleiche Kopiermarke wie die des Druckers von KJs Anwälten. Der Experte glaubt , dass die geleakten AEG Mails in KJs Anwaltsbüro kopiert/gedruckt wurden. Die "Vertraulich" Stempel seien ausgeschnitten worden.
(Ganz sicher könne er sich nicht sein, da er keinen Zugang zum Drucker des Anwaltsbüros hatte.)


Mann refused to identify his sources citing journalistic confidentiality. No one else sat for depositions. AEG wanted to depose Katherine and her lawyers.

Mann says he gave a box of documents to the reporter and did not know what was in the box. he now says there might be other sources.

Mann hat sich geweigert die Identität seiner Quellen bekannt zu geben. Sonst wurde niemand befragt. AEG möchte Katherine u. ihre Anwälte befragen.

Mann sagte, er habe dem Reporter eine Kiste mit Unterlagen gegeben, er wisse nicht was alles drin gewesen sei. Er sagt nun, dass es möglicherweise noch andere Quellen gäbe.

Mann says his friend Randall Sullivan introduced him to Perry Sanders whom he recommended Katherine to hire. Mann says he has a copy of Sander's retainer agreement with Katherine. It should have been a confidential document / private document for Katherine and no access to Mann. AEG uses this to argue that the documents could have been given to Mann by Sanders.

Janice Smith snippets is really short and it just consists of her saying in spring 2012 Katherine's lawyers brought a big binder of documents to Katherine's house to go over them. Janice didn't see the documents, Janice doesn't know what happened to the binder.

Mann's deposition is like I said is also partial. Mann's connection to Sanders through Sullivan, how he got him hired, and how he got Katherine's personal retainer agreement is used to show it's a possibility that Sanders might have given documents to Mann. Briefly Lowell Henry giving documents previously as well is also mentioned. So although the examples of documents given by Sanders and Henry is not relevant to this case they bring the suspicion that they might have given other stuff as well.

Mann is really vague about what he gave to LA Times reporter. He says he doesn't know what he gave to her. He says he only knows the box had a copy of the will and the trust he got it from the internet and he doesn't know the 99% of the rest of the documents. This seems fishy given that he sent an email to Lloyds stating to look out for the article about AEG's inside dealings.

It turns out Alan Duke found about the email Mann sent to Lloyds (probably Lloyds were denying that they were the leak and telling everyone what Mann sent to them) and asked Mann to confirm. Of course at that point Mann calls his email to Lloyds as stupidity and the thing that started this all. He wasn't very smart in hiding his involvement.
Es stellt sich heraus das Alan Duke über die E-Mail von Mann zu Lloyds herausfand(wahrscheinlich weil Lloyd`s leugnete, dass sie das Leck verursacht hatten und erzählten was Mann ihnen sandte) und baten Mann dies zu bestätigen. Mann really trashes Radar Online and also says that he worked with / employed News of the World before. (Didn't News of the World was the one that leaked Michael's trust documents?)

Mann explains his actions as to formulate a relationship with Lloyds and LA Times reporter. He wanted to exchange information and become a common adversary to MJ Estate. It seems like he emailed Lloyds before about "MJ Estate / AEG fraud" which Lloyds ignored too.

Now you are going to ask what is the "MJ Estate / AEG Fraud". Mann believes the insurance money should have been directly paid to the beneficiaries and MJ Estate and AEG is in an active fraud to get the money to themselves. What Mann fails to realize is that it's Lloyds who filed that lawsuit not to pay anything to anyone. He also fails to understand that this was a cancellation policy that MJ Company was a party. It wasn't a personal insurance.

Jetzt werdet Ihr fragen, was ist der "MJ Estate / AEG Betrug". Mann glaubt, dass das Versicherungs- Geld hätte direkt an die Begünstigten gezahlt werden müssen und MJ Estate und AEG machen einen aktiven Betrug um an das Geld, für sich selbst zu kommen. Was Mann nicht zu erkennen scheint ist, dass es Lloyds ist, die die Klage einreichten nichst zu irgendjemanden zu zahlen.. Er kann nicht verstehen, dass dies eine Ausfallversicherung war, und das die MJ-Company eine Partei ist. Es war keine persönliche Versicherung.

Mann mentions 4 additional sources but refuses to name them or provide any information based on journalistic privilege.

Oh and not surprisingly we learn that Randy Phillips and Roger Friedman had exchanged emails about Michael dating back to at least 2009. So KJ's lawyers claims that Phillips is the source of Friedman's articles how AEG will seek sanctions against the leaks. They also claim AEG gave the motion to Friedman before they were served. AEG counters this saying that Friedman got it after it was filed publicly. (Normally parties first file the motion with the clerks office and then serve it to the opposite side overnight. So any reporter can get the motion earlier if they get paper copies from the clerks office as they are filed)
Oh und nicht überraschend erfahren wir, dass Randy Phillips und Roger Friedman hatten E-Mails über Michael datierend aus 2009 ausgetauscht. So KJ Anwälte behaupten, dass Phillips die Quelle von Friedman`s Artikeln ist wo AEG Sanktionen gegen die Lecks ersucht hat.. Sie behaupten auch, AEG gab den Antrag zu Friedman, bevor er eingereicht wurde. AEG begegnet diesem und sagt, dass Friedman diesen bekam, nachdem es öffentlich eingereicht wurde. (Normalerweise füllen Parteien zunächst den Antrag mit dem Sachbearbeiter Büro aus und geben es dann der gegenüberliegenden Seite über Nacht. So irgendein Reporter kann den Antrag früher bekommen haben, wenn sie Papierkopien vom Sachbearbeiter Büro bekommen, wenn sie eingereicht werden)

Bei Randy`s Befragung gab es mal wieder Verschiebungen. Soll nun am 6. November stattfinden. Immernhin Jermaines vernehmung hat wohl stattgefunden, da es hierzu keine Terminverschiebungsanträge zu ersehen sind.

They filed it on October 25th saying they had a hard time communicating and organizing a deposition date. At the end Randy says he would sit for his deposition on November 6th. AEG lawyers agree to this date and they ask the judge to approve it so that Randy won't be in contempt of court.

The judge approves the delay saying that Randy would sit for his deposition on November 6th.


And a note : as there's no extension filed for Jermaine, it's safe to assume that he sat down for his deposition.

find ich gut so. ein kleiner Erfolg gegen AEG. da es ja in dem Prozeß mehr um die Rolle von Murray ging,bin ich sehr gespannt darauf, das man nun auch endlich die Rolle von AEG mehr beleuchten wird.Für mich spielen sie eine große Rolle in diesem Dilemma.

Judge rejects e-mail ban in Michael Jackson death lawsuit

Los Angeles (CNN) -- The judge presiding over the Michael Jackson family's wrongful death lawsuit against AEG rejected the concert promoter's arguments that family members were the source of leaked e-mails in the case.
AEG lawyers accused Michael Jackson's three children, his mother and their lawyers of giving the e-mails to a newspaper reporter in violation of the judge's order that they remain under seal.
"It is clear that only one entity could have done it," AEG lawyer Marvin Putnam said in a hearing last month.
Jackson family lawyers became furious in court, pointing out that AEG was accusing 10-year-old Blanket Jackson, the youngest of the children.
"What's the idea, that Blanket Jackson got some documents and copied them and somehow walked them from Calabasas to Harriet Ryan?" attorney Kevin Boyle said, pointing to Putnam.

Jackson lawyers denied anyone associated with their legal team or their clients leaked the e-mails, and suggested that AEG lawyers may have done it themselves as a set up.
Los Angeles Superior Court Judge Yvette Palazuelos issued her ruling on the question this week.
The communications, published two months ago in the Los Angeles Times, revealed the promoter had doubts about Jackson's health and his ability to be ready for his "This Is It" concerts several months before his death.
AEG wanted the judge to punish Katherine Jackson and the children -- Prince, Paris and Blanket -- by not allowing their lawyers to use the e-mails to convince a jury in a trial set for next April that the company contributed to the pop star's death.
Jackson died of an overdose of a surgical anesthesia in combination with sedatives on June 25, 2009, according to the Los Angeles County coroner. Dr. Conrad Murray, who was hired to be Jackson's personal physician as he prepared for the shows, was found guilty last year of involuntary manslaughter in his patient's death.
The Jackson suit contends that AEG contributed to the pop star's death by pressuring him to prepare even though the promoters knew he was in a weak condition and by its hiring and supervision of Murray.
"MJ is locked in his room drunk and despondent," AEG executive Randy Phillips wrote in a March 5, 2009, e-mail, the day Jackson announced the tour plans. "I (am) trying to sober him up."
Reporter Harriet Ryan has refused to disclose her sources, although Howard Mann -- who was once Katherine Jackson's partner in a book venture -- has acknowledged that he gave the reporter a box of documents for her story.
Days after the e-mails were published, AEG dropped its claim against a Lloyds of London underwriter for payout of a $17.5 million insurance policy on Michael Jackson.
The insurer contended AEG hid Jackson's health problems and failed to respond to repeated requests for his medical history when applying for insurance for the 50 shows scheduled for London's O2 Arena.
The Michael Jackson estate, which controls Michael Jackson Company LLC, is still pursuing the insurance payout.
Perry Sanders, who is Katherine Jackson's personal attorney, told the judge that the Jacksons had no motive to leak the e-mails.
"Like we would go and blow up our own case against Lloyds of London?" Sanders said. "Our client and all the plaintiffs in this case are actually the ones who would receive the money."
Sanders also noted that AEG had failed to disclose the e-mails to the Lloyds of London lawyers despite a legal requirement to do so.
While publication of the e-mails might have made AEG look bad, they were "extremely negative against Michael Jackson," painting him "as a basket case," Jackson lawyer Deborah Chang said.
"It's much more negative about Michael Jackson than it is about AEG, by far," Chang said.
The leaked e-mails include one written by Randy Phillips weeks after Jackson's death in which the president of AEG Live -- the concert-promotion branch of AEG -- called it "a terrible tragedy," but added "life must go on."
"AEG will make a fortune from merch sales, ticket retention, the touring exhibition and the film/dvd," Phillips wrote. AEG Live was allowed to sell Jackson tour merchandise and share in the profits from the documentary "This Is It," produced from rehearsal video.
The March 2009 e-mail from Phillips saying Jackson was "locked in his room drunk and despondent" indicate AEG Live's president saw Jackson's problems first-hand the day the pop star was to appear at the O2 Arena to publicly announce the shows.
"I screamed at him so loud the walls are shaking," Phillips wrote. "He is an emotionally paralyzed mess riddled with self-loathing and doubt now that it is show time."
The promoter blamed London traffic when Jackson was 90 minutes late for the announcement that day.
"He's as healthy as he can be -- no health problems whatsoever," Phillips told CNN two months later to refute reports Jackson's health was threatening the concerts.
The Los Angeles Times story, however, said the e-mails indicated major doubts about Jackson's ability to perform.
"We cannot be forced into stopping this, which MJ will try to do because he is lazy and constantly changes his mind to fit his immediate wants," AEG Live executive Paul Gongaware e-mailed to Phillips.
Jackson's missed rehearsals in June triggered concerns in e-mails that he was slow in learning his dance routines and would have to lip-sync on stage, the newspaper reported.
"MJ is not in shape enough yet to sing this stuff live and dance at the same time," one e-mail from the show's music director read, the paper reported.
A production manager wrote: "He was a basket case. Doubt is pervasive."
A loud warning from show director Kenny Ortega, who worked closely with Jackson on previous tours, came in mid-June, just over a week before the star's death. Ortega wrote to Phillips that Jackson had "strong signs of paranoia, anxiety and obsessive-like behavior" and suggested they bring a "top psychiatrist in to evaluate him ASAP."
"It is like there are two people there. One (deep inside) trying to hold on to what he was and still can be and not wanting us to quit him, the other in this weakened and troubled state," Ortega wrote. "I believe we need professional guidance in this matter."
Ortega testified at Murray's trial about his concerns about Jackson's frail condition and missed rehearsals. Those concerns resulted in a meeting six days before Jackson's death in which Murray assured the promoters he would have Jackson ready for rehearsals that next week.
An e-mail from Phillips after that meeting said he had confidence in Murray, "who I am gaining immense respect for as I get to deal with him more."
"This doctor is extremely successful (we check everyone out) and does not need this gig, so he (is) totally unbiased and ethical," Phillips' e-mail said.

nun, dann nimmst du aber auch in Kauf, dass Michaels Ansehen mal wieder in den Dreck gezogen wird.

Aber wenns die Familie nicht kümmert, warum sollte es die Fans berühren?!

Ich find es sowieso zum Kotzen, dass eine Anordnung des Gerichts einfach so mal ignoriert werden darf, ohne jegliche Konsequenzen.
Der Informatenschutz steht anscheinend über allem. Ich hätte diese Harriet Ryan veranlaßt ihre Quelle preiszugeben.

im Gegensatz zu Phillips und Konsorten habe ich mich nicht abfällig über Michael geäußert.Es zeigt einfach wie Michaels Zustand zu diesem Zeitpunkt war und deckt die Lüge von Philips auf, kurz nach dem Tod von Michael in IV s immer behauptet zu haben, das Michael in bester Verfassung gewesen ist.
Definitiv ist doch nun klar, daß das nicht stimmte und sie davon wussten und ich würde mit absoluter Bestimmtheit sagen: es war ihnen scheißegal.Hauptsache sie hatten ihren großen Clou an der Angel und die Melkkuh melkt wieder in ihre Taschen.
Sie kannten Michaels ausweglose Situation und stellten sich als die großen Retter dar, die dem armen Michael diese einzigartige Möglichkeit gegeben haben wieder Kohle zu verdienen mit seinem Riesenschuldenberg.
Michael wurde schon so lange niedergemacht, was ändern jetzt die mails daran? Eher tut es mir noch mehr leid, wie es um ihn stand. Vielleicht passt das vielen auch nicht, weil sie es nicht wahr haben wollen oder es nicht in ihr Bild von Michael passt. Warum klagen die Herrschaften dagegen. hat man vielleicht in ein Wespennest gestochen? Michaels Zustand war mehr als schlimm. Er war in physisch sehr schlechter Verfassung und das ist für mich oft schlimmer als die körperliche und nicht zu unterschätzen.
Diese mails sind für mich in keinster Weise schockierend, denn das war mir schon lange klar, aber jetzt hat man es schwarz auf weiß in diesem netten Mailaustausch der AEG Verantwortlichen.
Die Familie soll sich gegen diesen Sauladen wehren und diese emails zeigen eindeutig, das die Verantwortlichen einiges untern Teppich gekehrt haben und auch danach nicht unbedingt die Wahrheit gesagt haben.
Wenn diese Dokumente veröffentlicht wurden durch die familie( ist das denn überhaupt eindeutig bewiesen?) und das nicht hätte sein dürfen-ist das natürlich nicht korrekt, aber letzendlich scheint es ja auch keine Konsequenzen gehabt zu haben, oder?
gegen eine Macht wie AEG sie ist muß man manchmal auch mal mit solchen Mitteln kämpfen, sonst hat man keine Chance. Waren die immer fair?
Wir wissen nicht allzuviel, was da noch alles im Hintergrund läuft. Irgendwo hatte ich mal gelesen/gehört das AEG droht und auch eine Karen Faye wurde aufgefordert Beiträge/Kommentare die den Herren nicht passten von ihrer FB Seite zu löschen, was sie aber nicht macht. Wenns denn die Wahrheit ist, warum sollte man??

Taunya Zilkie`s Anhörung durch AEG wird am 13. Januar 2013 fortgesetzt. Sie hat zugestimmt Fragen, die sie vorher nicht beantwortete über ihre Beziehung zu Randy Jackson sowie zu Geschäftsbeziehungen zwischen Randy und Michael zu beantworten.

Gericht genehmigte Anfrage von KJ`s Anwälte für eine Befraung von Tohme am 11. Januar.

AEG bereitet sich auf sein Summary Judgement-Antrag vor und hat hier vom Gericht die Genemhigung erhalten die Beschränkung auf 22 Seiten um 5 Seiten zu überziehen.
