  • Also was ich echt erstaunlich finde ist die Berichterstattung von Alan Duke, der sich absolut zum Hofberichterstatter von K. Jackson und ihrem Lager entwickelt hat. Das war ja schon beim Sommertheater ersichtlich wo er letztendlich ja auch wohl offensichtlich von Trent Jackson gefüttert wurde.
    Wird interessant sein das weiter zu beobachten. Erstaunt mich aber tats., dass er als "seröser" CNN-Reporter einen Teil der derzeitigen Entwicklung des Rechtsfalles vollkommen zu verschweigen und sich das leisten kann. Im Vergleich wenn man die AP-Reports und die von einer jurist. Zeitschrift vergleicht wird das gravierend deutlich.

    Hier das Dokument zur gerichtlichen Entscheidung. Und wann man sich das durchschaut ist ja eine Begründung warum Punkt 2 stehenbleibt der Verweis auf Gongowares fühere Tourtätigkeiten und seine Kentniss der führeren Praktiken der Ärzte bei MJ-Touren bzw. seine generelle Kenntnis der Verfahrensweise von Tourärzten. Also mal abgesehen davon, dass es eine Argumentation ist, die darlegen soll, dass MJ bei allen Touren dies so betrieb, wird ja unterstellt dass Gongoware sozusagen der war der schon immer von allem Kenntis hatte.

    Summary first, documents below

    Claim 1 Breach of Contract

    a. Special Relationship

    Karherine argue AEG and MJ had a special relationship because AEG controlled all aspects of MJ's life including medical care, advisers, finances and financial future. However Katherine was not able to cite anything to back this up.

    Also Katherine was unable to show that AEG had complete control over Michael's medical care as Katherine herself admitted that Michael saw other doctors even one week before his death.

    So the court rules there's no special relationship between AEG and Murray.

    b. Negligent undertaking

    Katherine claims AEG had two undertakings : undertake Michael's medical care and provide an assistant to Murray.

    For the first one judge says Katherine could not provide any case law or prove it. And as Michael was seeing other doctors, judge rule that AEG did not undertake Michael's medical care.

    Judge rejects the undertaking for medical assistant as Katherine could not show it was asked for Los Angeles, Katie Jorrie testified the assistant was for London and the contract said Murray would choose the assistant - not AEG.

    c. Simple Negligence

    Katherine claims that AEG created a risk of harm to Michael.

    Judge says financial interactions do not create a duty. Judge also states given Michael's status (greatest entertainer with experience) exerting strong financial pressures is alone insufficient to create an undue risk of harm.

    Therefore Judge dismisses Claim 1 Breach of Contract

    Claim 2 - Negligent Hiring, Supervision and Training

    AEG argues they did not hire Murray and could not foresee the risks Murray posed.

    Judge states there are triable issues.

    Judge states that even though the contract was not signed, a jury must decide if Murray and AEG had a oral or implied in fact contract. Communications, Murray's expenses being budgeted and so on is listed as evidence. Judge makes a note that Michael retaining services of Murray before AEG hired him could be a factor in determining proportional damages and liability.

    AEG had argued that Murray was a licensed doctor and was not disciplined and Katherine argued they should have done a more detailed background check. Judge thinks this is a triable issue given that Gongaware had experience and knowledge about "tour doctors" and Michael's previous tours and "tour doctors".

    Judge also thinks whether Murray's debt could have been a reason to foresee if such doctor under strong financial pressure may compromise his oath. This is another triable issue.

    Therefore this claim will go to trial.

    Claim 5 Respondeat Superior

    Judge states that AEG's evidence established that Murray was an independent contractor and not an employee and AEG had no control over "means and manner" of Murray's work. Judge cites case law that doctors are considered independent contractors.

    Katherine claims that AEG hired Murray in part to ensure that Michael attended rehearsals. Judge says even this claim might be true, there's no evidence that AEG had any control over how Murray did that.

    Judge also mentions secondary factors that AEG Live had nothing to do with medical care, medical work performed by a specialist without supervision, medicines were provided by Murray and the contract and the parties clearly understood that the agreement was for an independent contractor.

    Therefore judge states there's no triable issue whether Murray was an employee and determines that Murray was an independent contractor.

    As Katherine fails to show any evidence that AEG had any control over how (manner or means) Murray did his job, judge dismisses the respondeat superior claim.

    • So wie ich die Posts die hier in den letzten Tagen eingestellt wurden verstehe, bestätigt sich mein Eindruck, den ich von Anfang an hatte.

      Die UNHEILIGE Allianz zweier Menschen, beide unter Druck, auf der einen Seite Michael psychisch wie physisch in einer schlechten Ausgangsposition und Murray zumindest aus den verschiedensten privat begründeten Schwierigkeiten in einer schlechten Ausgangsposition.

      Dazwischen AEG, die ALLES daran setzen, das beide, Michael und Murray zum VORTEIL VON AEG funktionieren und das tun, wenn auch unausgesprochen, was AEG erwartet.
      Einen Michael der durch die Hilfe EINES Arztes "auf Deuwel komm raus" fit gemacht werden soll, für eine Tour dessen Umfang von Michael SO wahrscheinlich noch nicht einmal angedacht ud geplant gewesen ist.

      Wie blöd muss ein so großer und seit Jahrzehnten etablierter Konzertveranstalter sein ?

      Hatten die Verantwortlichen unter ihnen, Michael das letzte Mal zu seinen besten Zeiten in den 80ern und frühen 90ern gesehen ?

      Haben sie danach nie wieder etwas über Michael gehört oder gesehen ?

      Ich sehe es so wie einige andere in ihren vorherigen Posts auch erwähnen.
      AEG hat sich nach ALLEN Seiten abgesichert, weil sie um Michaels Zustand WUSSTEN.

      Mag sein, da sie ja alle Eventualitäten wasserdicht mit einkalkuliert haben, das sie nach Paragraphen Richtlinien schuldlos sind, moralisch sind sie jedoch die größten Übeltäter in dieser ganzen Geschichte.

      Bleibt zu hoffen, das in Zukunft Künstler, deren Umfeld, Ärzte und andere den Mut haben sich gegen solche SITTENWIDRIGEN und MENSCHEERACHTENDEN Verträge zur Wehr setzen oder sich gar nicht erst auf solch einen Deal einlassen.

      • Also ich persönlich kann in den Mails von AEG nicht erkennen, dass sie Murray anwiesen Behandlungen zu unternehmen, die die Gesundheit von MJ aufs Spiel setzen könnten. Ich glaube schon, dass sie wollten das ein Arzt in dem Sinne schon nach der Gesundheit von MJ schaut, dass er fit zu den Shows (und das funtkioniert nicht in dem man Künstler vollpumpt) erscheint und ich denke sie hatten keine Bedenken bzgl. der Kompetenz von Murray. Es gab meines Erachtens schon die Bestrebungen, den anderen Ärztekonsum von MJ zu unterbinden (insbes. Klein), war ja wohl Thema des Treffens bei MJ, was ihnen allerdings nicht gelungen ist, was eigenzeitlich zeigt das ihnen die Kontrolle diesbezüglich überhaupt nicht gelang, denn MJ suchte bis zuletzt Klein auf.

        Mal was anderes. Hat denn jemand eine Ahnung in welcher Größenordnung eine Bestrafung von AEG liegen würde, würden sie bei diesem Prozess für diesen einen verbliebenen Klagepunkt schuldig gesprochen werden. Es ist eigentlich mittlerweile eine sehr reduzierte Klage.

        Trotzdem scheint die Jackson-Familie ja nun doch von einer weiterhin enormen geldlichen Entschädigung auszugehen. Der der Jackson-Familie nahe stehend Duke spricht weiterhin von einer Milliarden-Klage (Kompensation von dessen was MJ verdient hätte in seinem weiteren Leben, wäre er nicht gestorben) und dieser Artikel zitiert die Anwältin der Jackson-Familie laut Quelle, dass die Familie ein Settlement erwartet und potenziell 500 Mio. Auszahlung erwartet. Das Settlement-Thema hatten wir doch schon nach dem Leaken der E-Mails (meiner Meinung nach sollten sie tats. diesen Zweck bedienen), aber AEG zog ja dann weiter durch mit Beantragung des Summary Judgement womit sie 4 Klagepunkte ausschließen konnten.

        Do unsealed emails show concert promoter supervised Michael Jackson manslaughter doc?

        LOS ANGELES – This summer marks the fourth anniversary of Michael Jackson’s death, but the fallout surrounding his sudden passing continues.
        Last week, Superior Court Judge Yvette Palazuelos unsealed email documents in the wrongful death lawsuit filed by mother Katherine Jackson and Michael’s three children -- Prince, Paris and Blanket -- against concert promoter AEG Live.
        The judge dismissed all but one count, allowing the Jackson family to go to trial on April 2 with their claim that AEG negligently hired and supervised former cardiologist Conrad Murray.
        The ruling dismissed claims that AEG could be held liable for Murray's conduct and breached its duty to properly care for the pop superstar.

        The King of Pop died just two weeks before his highly-anticipated, AEG-promoted “This Is It” comeback tour was slated to hit the London stage, but the unsealed email exchanges allegedly indicate that the show organizers may have been aware of Jackson’s fragile health ahead of the big debut.
        “The emails reveal that AEG Live and Randy Phillips (the company’s President) knew Michael couldn't perform and that AEG Live hired Murray. They had long denied hiring him,” an inside source told FOX411’s Pop Tarts column. “This is and always had been one of the things the family noted, and AEG denied, which is that they hired Murray. The family believes now that AEG will be inclined to settle and pay out potentially $500 million.”

        A key component in the Jacksons’ suit against the entertainment promotion subsidiary of AEG is an alleged email sent to Phillips from show director Kenny Ortega, a longtime confidante of Jackson, expressing fear over the health of the star performer – who apparently turned up to rehearsals shivering – and asking for “professional guidance in this matter.”
        Phillips allegedly responded that Dr. Conrad Murray, who is now serving out a prison sentence for involuntary manslaughter having administered a deadly dose of propofol and sedatives to Jackson, was “extremely successful” and that he “does not need this gig and is totally unbiased and ethical.”

        Another email sent to Ortega 11 days before Jackson’s death, from AEG Live Co-CEO Paul Gongaware, suggested that the promoters were upset Murray kept Jackson from attending rehearsals the previous day, and allegedly cautioned: “we want to remind (Murray) that it is AEG, not MJ, who is paying his salary. We want to remind him what is expected of him.”
        The Jackson family has long advocated that AEG Live put tremendous pressure on Jackson’s personal physician to keep his $150,000 per month job tending to the world’s biggest musical star and ensuring that he be ready for the tour, irrespective of his health.

        The Jackson family’s attorney, Kevin Boyle did not respond to a request for comment. However, AEG lawyer Marvin Putnam vehemently denied any wrongdoings on his client’s behalf.
        The emails that have been unsealed are two out of thousands in this case. They have been cherry-picked by plaintiffs and twisted to say something they simply do not say. The Court’s ruling on Friday specifically found that AEG Live did not control Dr. Murray’s treatment of Jackson. Moreover, as we have said repeatedly, AEG Live never paid Dr. Murray a penny. Nor did it pay for any of his equipment or the propofol he used to treat Jackson,” he said. “ In fact, Dr. Murray purchased that propofol and was treating Jackson long before Jackson told AEG Live that he wanted to add Dr. Murray to his Tour Party.”

        As for AEG’s knowledge regarding Jackson’s health, Putnam referred to the testimony given by Ortega, Phillips, and Gongaware in the criminal trial of Murray last year.
        “(Michael) appeared ill one night during rehearsals, June 19, 2009. Ortega suggested that AEG Live reach out to Michael and his personal physician, Dr. Murray, to make sure Michael was okay. Randy Phillips did so, and as the very emails you have show, Dr. Murray told Phillips that Jackson was healthy and well, and that stopping the show would be the worst possible thing for him,” he said. “The next day, Phillips and Ortega met with both Jackson and Dr. Murray. Jackson appeared well, and insisted to everyone that he was fine. Dr. Murray likewise assured everyone that Jackson was fine. He then took a couple of days off, and came back to rehearsals later that week with the best performances he’d had the entire rehearsal period.”

        But a source close to the Jackson’s contended that the famous family – who are seeking a financial sum equal to the money Jackson would have earned in his future years if not for his premature death – remain confident that they will receive some form of monetary compensation as the case heads to trial.

        “They feel that a lawsuit victory or settlement proves their theory that Michael's death was more of a conspiracy than just Murray giving a lethal dose of propofol,” said the insider.
        Putnam told the Associated Press he expects the company to win at trial, and that Katherine Jackson's lawyers will be unable to prove that AEG should have foreseen that Murray was a danger to the "Thriller" singer.

          Letzteres von mir ein eindeutiges 'nö'!

          Da schliesse ich mich an. Es wäre seltsam was anderes anzunehmen.


          Fragt sich nur, was AEG verantwortliche unter 'gesundheitsfürsorge' und 'fit machen' für die proben und shows verstanden und was MJ darunter verstand und von C.M. einforderte und unter welchen bedingungen das erfüllt wurde - bis zur bitteren neige. Dass MJs allererstes und dringendstes bedürfnis das nach regelmässigem und ausreichend erholsamen schlaf war, dürfte zumindest C.M. klar gewesen sein - ich habe meine zweifel, dass die AEG verantwortlichen das komplette ausmass der ausgeprägten schlafprobleme und ihre wahren ursachen gekannt haben. Kann sein, dass K. Ortega und P. Gongaware parallelen zu frühren tourerfahrungen mit MJ hatten - ist (für mich) die frage, inwieweit sie mit vorsorgenden gesprächen einiges hätten im voraus absichern können; abseits von dem, was kompetente ärzte/terapeuten zum wohl von MJ hätten ausrichten können.

          Körperlich und mental fit machen, ich glaube nicht, dass ein leibarzt dafür die richtige und vor allem alleinige adresse war, es sei denn das ganze beschränkte sich ausschliesslich auf medikamentöses fit machen.

            • AEG ist vor das Berufungsgericht gegangen. Übrigens kennen wir jetzt die Schadensersatzforderung der Jacksons. 40 Milliarden

              Summary

              The documents starts with saying Jacksons seek $40 billion damages from AEG Live.


              AEG is stating that the Superior Court had made an error because it didn't explain how AEG should have foresee Murray would administer Michael fatal Propofol given that Murray "may" compromise his oath due to his debt and Michael had addiction to painkillers years ago. AEG states that the law requires a more direct relationship.

It also creates legal negligence to hire licenses professional with personal debts. AEG states this is a problem for California employers and workers.

              Some background

              As we know AEG and Michael have agreed to do a tour. Salaries of tour personnel were being advanced by AEG but later will be recouped from Michael's share of profits.

              In late March early April 2009 Murray moves to LA and starts to treat Michael 3 times a week. Late April early may 2009 Michael told AEG he intended to bring Murray with him to London. AEG started negotiations with Murray, they were going to advance Murray's salary from Michael's share. When Michael died no contract were signed. Drafts of the contract said Murray was an independent contractor, it required Michael's signature, it said the parties have no rights or obligations to each other until the contract was signed. Michael's signature block clearly said he wanted Murray and was paying him from his own share of profits. The contract also required Murray to administer services "professionally and with greatest degree of care expected". It required Murray to have licenses in US and UK and maintain malpractice insurance.

              Michael died of Propofol overdose. DA charged Murray with manslaughter and a criminal court convicted him of manslaughter and gave him the maximum sentence.

              Michael's mother and children sued AEG. 2 claims dismissed at demurrer, 3 remained. AEG filed a motion for summary judgement. 2 of the remaining claims dismissed, only negligent hiring claim remained.

              AEG argued they could not foresee the risk Murray had because

              - There's no dispute that Murray treated Michael for 3 years with no issues.

              - AEG argues Murray's debt or Michael's past painkiller addiction would not make it foreseeable that Murray will commit criminal manslaughter by administering anesthesia to Michael in his bedroom. AEG states CA law requires a direct relationship between the "warning sign" and the harm suffered.

              - AEG states there's no direct connection between Michael's 2009 anesthesia overdose and Murray's debt and Michael's past painkiller addiction.

              - Courts ruling creates a legal inference that people with debt are morally suspect and unfit for positions of responsibility even if they have taken oaths and have no history of wrong conduct. This will be problematic for workers and organizations.

              - AEG states CA law states a person has no duty to protect a person from a third party's actions, especially these are criminal conduct. Negligent hiring is a small exception but it requires knowing the employee causes a particular risk and that particular harm happening.

So the only relevant issue what AEG knew or should have known about Murray. AEG states they knew nothing that would put them on notice that Murray might overdose Michael with surgical anesthesia in his bedroom.

              - AEG says there's no law that evaluates a physicians competence based on pressure their patients could assert. AEG states it's wrong to question credentials of doctors because they treated former addicts or famous people. AEG says if this is the case no doctor would treat former addicts or famous people.

              - AEG states law says that a doctors competence is determined by licenses unless there's specific evidence of incompetence.

              - AEG states Superior Court also made a mistake in saying Murray's debt could be a factor in determining his competence.

              - AEG states personal debts do not make a person professionally incompetent. There was no reason to think Murray's debt would cause him perform poorly or commit manslaughter.

              - AEG states there's no direct connection between the alleged warning (debts) and the actual harm (criminal manslaughter due to anesthesia overdose). There's no relationship between debt and medical malpractice.

              - AEG says even though they have invaded Murray's financial privacy and did a credit check on him and uncovered his debts, they couldn't have anticipated that Murray would overdose Michael with anesthesia in his bedroom.

                Katherine Jackson’s Wrongful Death Lawsuit Suffers Major Legal Setback

                Katherine Jackson‘s suffered a huge legal setback this past week in her wrongful death lawsuit for her son Michael Jackson when a California court dismissed all of her claims against AEG and its President Tim Leiweke RadarOnline.com is exclusively reporting.

                Additionally all but one of her claims against the remaining defendants were dismissed and the California Court of Appeals ordered Michael’s medical records unsealed.


                Those remaining defendants have filed legal documents with the Court of Appeal in California to dismiss that one remaining claim on the question of whether AEG Live negligently hired Dr. Conrad Murray, Jackson’s long time personal physician. Murray was convicted in 2011 of the involuntary manslaughter death of Michael Jackson after administering a fatal dose of propofol to help the pop singer sleep. Murray hadn’t signed formally signed his employment contract with AEG at the time of Jackson’s death.

                In response to the filing, the Court of Appeal indicated that it would be unsealing certain records of the late pop singer, including Jackson’s medical records.

                In court documents obtained by RadarOnline.com, AEG Live asserts, “absent this Court’s immediate intervention, defendants will shortly begin a long trial based on the trial court’s fundamental misapplication of California law. Plaintiffs seek more than $40 billion in damages from defendants arising from the 2009 death of pop music star Michael Jackson….On February 27, 2013, Respondent Court summarily adjudicated all of the Jackson’s claims except negligent hiring….Specifically, Respondent Court held that there was a triable issue of fact as to whether AEG Live should have suspected Dr. Murray “may compromise his Hippocratic Oath” because Dr. Murray was in debt, and because Mr. Jackson was known to have had a prior problem with painkiller abuse. Respondent Court provided no explanation as to how such knowledge would have made it legally foreseeable that Dr. Murray would administer a fatal dose of anesthesia to Mr. Jackson in his home for sleep.”

                When contacted by RadarOnline, com, Marvin Putnam, attorney for AEG Live responded, “The Court of Appeal rarely grants these extraordinary requests, although I am confident, whether before or after trial, that the courts of this state will find the law does not allow Mrs. Jackson’s claim. Any other outcome would wreak havoc on California’s business community.

                If the case does proceed to trial, Putnam told us, “AEG Live had no idea Jackson was looking for a doctor to give him propofol or that Dr. Murray had agreed to provide the dangerous drug to him. Mr. Jackson’s death was a horrible tragedy for which AEG Live is simply not responsible.

                Murray is going to be deposed on Monday, March 18 at the Los Angeles County Men’s Central Jail in connection with Katherine’s wrongful death lawsuit.

                The trial is expected to begin on April 1.

                  Both parties have filed their motions to exclude certain topics to be mentioned during trial. The judge will hear the arguments and decide on these motions on March 21 (or later). The following are the summaries of both parties’ motions.

                  AEG Live

                  AEG Live states that the jury will decide on 4 narrow issues

                  1- Whether AEG Live hired Murray
                  2- Whether Murray was unfit
                  3- Whether AEG Live had a reason to believe an undue risk of harm would exist due to Murray
                  4- Whether harm occurred.

                  Based on this AEG Live asks the judge to exclude the following:

                  Speculative Damages

                  The $40 billion damages are now becoming clearer. Each plaintiff (Katherine, Prince, Paris, Blanket) is asking for $50 Million in general damages and $10 Billion in special damages (it brings it to $200 M total in general damages and $40 billion in special damages). It turns out Katherine’s side is speculating Michael’s possible future income and AEG wants this to be excluded as California law says the damages should be “reasonable certain to result in the future” and “possibility or probability” is not enough. AEG says all of these based on casual conversations and wishful thinking and hypothetical scenarios and nothing was certain.

                  The possible future income sources are
                  - Possible future tours after TII
                  - Possible future albums
                  - Possible future increased on royalties from already released albums
                  - Possible future film career
                  - Possible future clothing line
                  - Possible future appearances
                  - Possible future purchase of Marvel comics
                  - Redacted but based on something Tom Barrack said

                  Jacksons claim Michael would have earned $500 Million a year for the rest of his life and would give 40% of his earnings to Katherine and his kids. AEG states if you do the math to reach to the $40 billion number it would have required Michael to live 200 more years. ( Math : 40% of $500 M a year = $200 Million a year. $200 Million a year times 200 years gives $40 billion).

                  AEG also mentions that these numbers aren’t realistically possible as Michael’s popularity was down due to child molestation allegations and he hasn’t performed for years. AEG also mentions how Katherine stated during her deposition that Michael did not want to tour anymore but now also claiming lost income from future tours. AEG also lists details of Michael’s past movie projects that never happened, clothing endorsements that ended in lawsuits and so on to demonstrate that there is no certainty that any of these future business projects would have actually happened or be successful. AEG also mention that Marvel was sold for $4.2 billion (meaning Michael could not have afforded to buy it at all).

                  AEG has no objection to any lost income from TII to be considered in determining damages.

                  Irrelevant interactions between AEG and Michael

                  AEG Live states given the 4 issues to be considered at the trial the following is irrelevant: AEG and Michael’s financial bargaining power during negotiations and preparation of the tour, cash advances made to Michael, number of concerts scheduled and AEG firing nanny Grace on Michael’s request.

                  It turns out Katherine planned to introduce AEG’s and Michael’s financial bargaining power to show AEG had control over Michael. AEG states as the first claim is now dismissed, these matters are irrelevant to the remaining 1 claim and should be excluded. AEG also states that any mention of “control claims” should be excluded. This also includes a request for the exclusion of AEG emails that mention “has to perform or a financial disaster awaits”, “he has no choice, he has to do it he signed a contract” etc.

                  AEG says if Katherine is allowed to mention these control claims, AEG in return will show that it was Michael’s advisors that approached them for a tour, 3 business managers of Michael looked over and approved tour expenses, it was Michael’s requests that increased the tour expenses and so on.

                  We learn that during summary judgment Katherine stated that AEG used cash advances to “reel him in”. We also learn that Katherine’s lawyers especially asked questions about a $200,000 cash advance that Phillips took to Michael in a brown paper bag. It seems like Katherine’s side wants to portray these as under the table advances. AEG argues that advances are no longer relevant to the remaining issues and AEG Live states regardless of how they have given Michael advances he has signed receipts for them and they are all properly documented and accounted for.

                  AEG says the number of shows Michael agreed to perform is irrelevant to the topic that whether AEG hired Murray or not. AEG also want to exclude testimony from Prince that might claim AEG was forcing Michael to do more shows than he want and AEG state that they have counter witnesses that would testify that Michael told them he was excited to perform “50 shows”.

                  AEG says Gongaware firing nanny Grace at Michael’s order is irrelevant to the matters at hand. They say AEG never employed or paid Grace and Gongaware was given an already prepared letter and just contacted Grace because Michael told him to.

                  Hypothetical scenarios of cancellation or postponement of TII

                  Given the remaining single claim AEG Live states that Katherine’s previous arguments of AEG could have saved Michael’s life if they postponed or cancelled the concerts are no longer relevant and should be excluded. AEG also states that according to the contract AEG could not have canceled the concerts on their own, any cancellation required Michael’s permission. AEG states they have evidence that Michael wanted the concerts to continue, he didn’t need time off and he didn’t want them delayed.

                  AEG also states that Jacksons try to mention these irrelevant matters to create a moral blame on AEG and even go to the media (CNN Alan Duke’s smoking gun story) to hurt their reputation rather than litigating the case.

                  Michael’s intoxication before O2 press conference

                  AEG says whether Michael was drunk before O2 press conference or whether AEG knew he was drunk is irrelevant as Michael did not die from alcohol but he died from anesthesia. AEG also states that this press conference happened at least a month before they heard about Murray and there’s no evidence that Murray was at UK that time or provided him medical care before press conference.

                  We also learn that Jacksons first want to exclude any possible “Michael Jackson is an alcoholic” claims but they later changed their minds.

                  Murray’s character as it relates to his personal life

                  AEG Live states given the 4 issues to be considered at the trial whether Murray frequented strip clubs and whether a small part of his debt was child support is irrelevant and should be excluded. (The argument here is that whether a doctor visits strip clubs on his personal time cannot be relevant to whether the doctor will compromise his oath.)

                  AEG Live and AEG Inc.’s financial condition

                  AEG Live states given the only claims are Murray’s hiring and there are no punitive damages in this trial to punish AEG, their financials are irrelevant and should be excluded.

                  Personal relationship between Gongaware and Segal

                  Gongaware meets Segal during Michael’s History tour. Segal was working for one of Michael’s tour promoters at that time. Later Gongaware and Segal have a romantic relationship. Segal never worked for AEG. In 2009 when Michael was looking for a tour manager, Gongaware recommended her to Michael and Michael who knew her from History tour hired her to be a part of MJJ Productions. AEG argues the personal relationship between Gongaware and Segal is irrelevant to the remaining negligent hiring of Muray claim. Note: Segal’s responsibilities were to arrange housing for Michael in London and arrange his travel.


                  Katherine Jackson

                  Katherine Jackson wants to exclude the following

                  Exclude the mention that Katherine and MJ’s kids did not sue Murray

                  Katherine’s lawyers state that they expect AEG to argue that Katherine could have sued Murray but choose not to because she was looking for a deep pocketed defendant and they want the judge to exclude such claims.

                  Exclude benefits Katherine and MJ’s kids receive from MJ Estate

                  Katherine’s lawyers state that they expect AEG to argue that Katherine and MJ’s kids are receiving money from MJ Estate and they will use this to reduce the any amount of damages the jury might award so they want the judge to exclude such claims.

                  Ps: this motion makes reference to medical insurance benefits in addition to what they get from the Estate.

                  Exclude marital discord between Katherine and Joe

                  Katherine’s lawyers state that they expect AEG to introduce evidence that Katherine and Joe have a turbulent or unhealthy marriage and will use this to make Katherine look bad in front of a jury. They want the judge to exclude these.

                  Exclude the argument that Michael’s siblings have financial problems

                  Katherine’s lawyers state that they expect AEG try to introduce evidence that Michael’s siblings suffer or have suffered from financial woes and says that this is irrelevant and it should be excluded.

                  Exclude molestation charges

                  Katherine’s lawyers state that AEG lawyers have asked during depositions to multiple people about the molestation charges and they expect AEG to mention those to make Michael bad and they want the judge to exclude those.

                  (Ivy’s note: Molestation charges is mentioned in AEG documents as a reason for lower income level expectations).

                  Exclude evidence of biological parents of minor kids

                  Katherine’s lawyers say AEG might try to introduce evidence to cast doubt on the biological parents (both father and mother) of the minor kids and it should be excluded as it is irrelevant.

                  Exclude that Katherine was kidnapped to Arizona

                  Katherine’s lawyers say that AEG may try to introduce evidence that Katherine was kidnapped to Arizona to cast the Jackson family in a bad light and it should be excluded as it is irrelevant.

                  Exclude that Michael Jackson Estate did not file a lawsuit against AEG or anyone else in regards to Michael’s death

                  Katherine’s lawyers say that they anticipate that AEG will argue that MJ Estate did not join Katherine’s lawsuit to demonstrate that Katherine’s lawsuit lacks merit or based on baseless allegations. They want it to be excluded.

                  Exclude testimony from David Fournier that Michael tried to deceive him during surgery

                  Fournier is a nurse anesthetist that provided medical treatment to Michael in 1990s and 2000s. Fournier believes on one or two occasions Michael deceived him by not telling him about a “narcan implant” Michael inserted in his body before surgical procedure Fournier was helping with. Fournier states he believes Michael did not intentionally tell him about the “narcan implant” because he knew Fournier wouldn’t have administered him anesthesia if he knew.

                  Katherine’s lawyers state they expect AEG to introduce this at trial to show that Michael is a liar and tried to deceive a health professional. They want it to be excluded as it is speculative and irrelevant.

                    • also die Personen die auf diesen Listen stehen klingen ja hochinteressant. Und wenn nur ein Bruchteil der genannten Personen aussagen wird.Ich bin gespannt auf die Aussagen. Es wird sicher wieder viel um Medikamentenmissbrauch und Abhängigkeit gehen. Ich hoffe AEG geht es so richtig an den Kragen, aber wirklich belangt werden sie ja nicht.Über einen möglichen Zahlbetrag einiger Milliönchen lachen die sich doch ins Fäustchen. Dies wird kein öffentlicher Prozess werden, so das die Machenschaften und "Hinter den Kulissen" mal ans Tageslicht gebracht werden für die breite Öffentlichkeit. Gibt es Infos darüber wie lange das gehen wird?
                      wird man das mitverfolgen können, wer wann an welchem Tag was aussagt? Gibt es dazu Dokumente, die man einsehen kann, wie bei Michaels Prozess?

                      Ich hoffe danach kehrt dann Ruhe ein und die Jacksons haben für sich ihre Antworten gefunden. Kein Geld der Welt bringt ihnen Michael wieder. AEG und die geplante Konzertserie sind am Ende einer langen Kette von Ereignissen in Michaels Leben, die ihn zu Grunde gerichtet haben. Ich denke im Grunde genommen wissen sie das auch.Es war eine Folge von vielen Dingen, die zusammen gespielt haben und manchmal denke ich, es musste so enden. Ein normaler Tod wäre für Michael nicht in Frage gekommen. Es sollte so sein. Bei so einem Leben wirst du nicht alt.

                      • Ich glaube nicht, dass es den Jacksons um Geld geht! Vermutlich geht es einfach um die Wahrheit, wie sie es immer betont haben. Um Wahrheit und Gerechtigkeit. Zuviele Ungereimtheiten ereigneten sich damals.
                        Natürlich kommt Michael leider nicht wieder, aber vllt hilft es, dass es anderen nicht ähnlich ergeht!?

                        • Ich würde den Jacksons jetzt auch nicht nur Gier unterstellen.

                          Ein normaler Tod wäre für Michael nicht in Frage gekommen. Es sollte so sein. Bei so einem Leben wirst du nicht alt.
                          Andererseits ist ein exJunkie wie Keith Richards ü 60.

                            LOS ANGELES (AP) — Billionaire Philip Anschutz says he is pulling AEG off the market and the company that owns the Los Angeles Kings and the Staples Center is no longer for sale.

                            Anschutz said in a statement Thursday that he had made clear that he wouldn't sell the company unless the right buyer came forward. He says he will resume a more active role in the company and Tim Leiweke, who has served as president and CEO, is leaving.

                            The sports and entertainment company was expected to fetch billions of dollars.

                            AEG's holdings also include the Los Angeles Galaxy, part-ownership of the NBA's Los Angeles Lakers, and major entertainment and real estate holdings in Los Angeles.

                            AEG also is spearheading a stadium proposal to bring back a professional football team to Los Angeles.

                            • Ich glaube schon, dass es den Jacksons bei dem Prozess nur ums Geld geht. Andere Indizien sehe ich nicht. Daher auch die bewusste Entscheidung vom bankrotten Murray keinen Schadenseratz zu verlangen und ihm damit alle Optionen zu geben, nach seiner Haftstrafe mit Publikationen und IV`s über MJ groß abzukassieren.

                              Sollte AEG den Jacksons kurz vor knapp ein Settlement anbieten, gehe ich jede Wette ein, dass sie es annehmen werden(sollte es für sie noch lukrativ genug sein und die Gefahr vor Augen habend beim Prozess ganz leer auszugehen)

                              Die Jacksons haben von sich aus nun die Vernehmung mit Murray gecancelt. Der Grund dafür? Die Aussage, dass Murray beabsichtigt nicht auszusagen kann, es ja wohl nicht sein. Dies ließ Murrays Anwältin ja schon vorher verkünden. Von daher finde ich die Aussagen diesbezüglich von AEGs Anwältin recht sinnig

                              Los Angeles (CNN) -- Dr. Conrad Murray, who was Michael Jackson's personal physician, is refusing to testify in the wrongful death lawsuit that the singer's mother filed against concert promoter AEG Live.

                              If called, he will plead the fifth so as not to incriminate himself, the doctor said in a statement sent to the Jackson family.
                              Murray has never been questioned under oath about Jackson's death, which occurred on his watch.

                              He did not testify at his trial, where he was found guilty of causing Jackson's death on June 25, 2009, by administering a deadly overdose of sedatives and the surgical anesthetic propofol in what he told police was an attempt to cure the singer's insomnia.
                              He is serving a four-year sentence but could be out in two.

                              On Monday, he was supposed to be deposed in the wrongful death suit.
                              But lawyers for Jackson's mother, Katherine, and her three children called off their jailhouse visit because Murray swore "he would not answer any questions at the deposition or the trial," Jackson lawyer Kevin Boyle told CNN. He said the Jackson case would not suffer without his testimony.

                              AEG's lawyer suggests the Jacksons canceled Murray's deposition because his testimony would "destroy" their case.
                              "They are not interested in the truth," said the lawyer, Marvin Putnam.

                              Asserting his 'Fifth Amendment privilege'
                              The cancellation came after Murray's attorney Valerie Wass sent the Jacksons a sworn statement signed by Murray making it clear he would not answer any questions while his involuntary manslaughter conviction in Michael Jackson's death is being appealed.
                              "Accordingly, if I am called or ordered to testify at deposition or trial in the Katherine Jackson vs AEG wrongful death case, I will be asserting my Fifth Amendment privilege against self-incrimination and refuse to answer any questions," Murray's declaration said.
                              Jury selection in the civil trial is set to begin April 2 in a Los Angeles County court.

                              Prince Jackson, the pop star's oldest son, is expected to testify about his father's last days.

                              Jacksons: Focus back on AEG
                              The Jackson lawsuit contends that AEG Live is responsible for Jackson's death because it hired and supervised Dr. Murray, who was administering the surgical anesthetic propofol to Jackson each night for a month to induce sleep as he prepared for a series of concerts organized by AEG Live.

                              A jury found Dr. Murray guilty of involuntary manslaughter after hearing testimony that he violated medical standards in his treatment of Jackson.

                              "Dr. Murray's choice to keep quiet puts the focus back on the company, AEG, that hired Dr. Murray and agreed to pay him over $1.5 million a year, and provide Murray with a large house and drivers and other perks, to make sure that the company's biggest asset, Michael Jackson, made it to the shows on time, no matter what," Boyle, the Jacksons' lawyer said.

                              A judge ruled last month that Jackson lawyers could question Murray at the Los Angeles County jail, where he is serving his prison sentence.

                              AEG: Testimony destroys Jacksons' claim
                              "The Jacksons told the world that they wanted Dr. Murray's deposition, and then when the Court gave it to them, they canceled it," Putnam, the AEG lawyer, told CNN on Sunday.

                              "They have had all of their claims dismissed except negligent hiring, and they don't want Dr. Murray to be deposed because he will tell them what he already told the police: that he worked for Michael Jackson; that Michael Jackson, not AEG, was his employer; and that Michael Jackson personally invited him to join the 'This is It' tour long before anyone at AEG had even heard of him. The Jacksons canceled the deposition because that testimony destroys the only claim they have left. They are not interested in the truth."

                              Back and forth
                              The Jacksons' lawyer argued, in response to Putnam's comment, that AEG was not interested in having Murray take the stand in the trial.

                              "AEG did not even try to get Dr. Murray to talk," Boyle said. "AEG is simply not telling the truth. AEG can't run from the fact that they hired the man who is in jail for killing the greatest entertainer the world has ever known."

                              Wass, who unsuccessfully objected to the deposition, said she advised Murray to invoke his Fifth Amendment right to not answer questions because of his appeal. The appeal brief is expected to be filed next week.

                              Jacksons plan to use e-mails
                              Jackson died two weeks before his "This Is It" comeback concerts, organized by AEG Live, were to have debuted in London in the summer of 2009.

                              E-mails the Jackson's plan to use in their case suggested that the promoter was worried about Jackson's missed rehearsals and they sought Murray's help in getting him ready.

                              Prince, Paris and Blanket Jackson and their grandmother contend that AEG Live's pressure on Murray to have Jackson ready for daily rehearsals despite his fragile health led to his death from the propofol overdose.

                              A cornerstone of the Jacksons' case is an e-mail AEG Live co-CEO Paul Gongaware wrote 11 days before Jackson's death.
                              The e-mail to show director Kenny Ortega addressed concerns that Murray had kept Jackson from a rehearsal the day before: "We want to remind (Murray) that it is AEG, not MJ, who is paying his salary. We want to remind him what is expected of him."

                              Jackson lawyers, calling it a "smoking gun," argue the e-mail is evidence that AEG Live used Murray's fear of losing his $150,000-a-month job as Jackson's personal physician to pressure him to have Jackson ready for rehearsals despite his fragile health.

                              Billions at stake
                              The lawsuit seeks a judgment against AEG Live equal to the money Jackson would have earned over the course of his remaining lifetime if he had not died.

                              If AEG Live is found liable, it could cost the company several billion dollars, according to estimates of Jackson's income potential.
                              AEG Live is a subsidiary of AEG, a global entertainment company that was recently for sale with an $8 billion asking price.

                              The company announced last week it was no longer for sale.

                              • Ich habe keine Erwartungen oder Hoffnungen bzgl. dieses Prozesses. Ich halte die Jacksons für völlig inkompetent was diese Sache betrifft und ich glaube nicht, dass die was reißen können. Die meisten Anklagepunkte sind ja eh schon vom Tisch, jetzt fällt auch Murrays Aussage weg, und AEG ist eine gut abgesicherte Firma. Über 40 Milliarden Dollar Schadensersatz kann ich nur lachen, und wahrscheinlich stimmt AEG ins Gelächter mit ein. Mag sein, dass ich (mal wieder) zu schwarz sehe, aber ich gehe jede Wette ein, dass bei diesem Prozess nichts bei rum kommt und die Jacksons da mit $0 rausgehen - und dass wir nachher so klug als wie zuvor dastehen.
