Joe sagt, dass er Murray auf 500 Mio. verklagt, aber Murray ist nur der "Fall Guy". Es gibt eine Menge anderer Leute. Er klagt so hoch, weil je höher man klagt, desto mehr kriegt man.
Michael ist sein Sohn. Er will Gerechtigkeit.
Nach einen Schnitt im Gepräch sagt er noch etwas zum Oprah-Besuch auf die Frage, ob er Oprah hinterhergelaufen sei. Nein, das wäre er nicht, sie wäre um ihn herumgewesen.

Judge Declines to Hear Jackson Wrongful Death Case

Judge tosses wrongful death case filed by Michael Jackson's dad; lawsuit goes to state court

A wrongful-death lawsuit filed by Michael Jackson's father will now be handled by a state court after a federal judge said Monday he didn't have authority to hear the case and that the singer's father would be unlikely to collect tens of millions of dollars in damages in his court.

Joe Jackson's attorney agreed to dismiss part of his case against the doctor charged in the pop superstar's death, which prompted the judge to rule that the remaining issues had to be heard in state court.

U.S. District Judge John F. Walter opened a hearing Monday by telling Joe Jackson's attorney that he didn't think Jackson's father could receive any money from one of the major causes of action, which alleged the singer's rights were violated under the Americans with Disabilities Act.

"I am firmly convinced that you can't seek damages on this (disabilities act) cause of action," Walter said.

The judge said that was the only federal issue in the case and he would not handle any other issues. "This is a creature of state law, this wrongful death claim," the judge said.

Joe Jackson's attorney, Brian Oxman, agreed to dismiss the ADA-related claim and said he would refile the case in Los Angeles Superior Court soon.

Walter had previously expressed doubts that the case belonged in federal court, but had allowed it to remain until the case's first scheduling hearing Monday.

The lawsuit will likely join a case filed by the Jackson family patriarch's wife against concert promoter AEG Live. Katherine Jackson sued the company, which planned and promoted a series of London concerts Michael Jackson was preparing for when he died unexpectedly in June 2009.

She has accused the promoter of failing to give Dr. Conrad Murray lifesaving equipment and properly oversee him while he cared for her son during preparations for the concerts. AEG has said the lawsuit is meritless.

"Given the two cases pending, it makes no sense to have them separated," Oxman said. "It's a matter of practicality."

Murray has been charged with involuntary manslaughter and was named in Joe Jackson's lawsuit, but not in the case filed by Katherine Jackson.

Murray's attorney, Charles H. Peckham, told Walter that there would still be legal hurdles in state court for Joe Jackson's lawsuit. He said after the hearing that Murray will challenge whether the elder Jackson has the right to sue for wrongful death.

Authorities have accused Murray of giving Michael Jackson a lethal dose of sedatives, including the anesthetic propofol, in the bedroom of the singer's rented mansion. Propofol is meant to be used in hospital settings.

Murray has pleaded not guilty.

Walter also said Monday he didn't want to wait for Murray's trial to conclude, and he warned the attorneys that if the case remained in his courtroom, it would not be significantly delayed.

"I'm not going to wait around for two years, if you think that's how long the criminal case is going to take," the judge said.

Murray is due back in criminal court Jan. 4 for the start of a preliminary hearing where prosecutors will lay out some of the evidence against him. His attorneys have said he did not give the one-time King of Pop anything that should have killed him.

Das von JJ angerufene Gericht erklärt sich in der Schadensersatzklage wegen widerrechtlicher Tötung für nicht zuständig.

Der Richter des federal court erklärte, dass er überhaupt nur für den Teil der Klage zuständig sei, der die Verletzung des Americans with Disabilities Act (ADA) betrifft. Er sei aber davon überzeugt, dass JJ auf dieser Grundlage keinen Schadensersatz erhalten werde.

Dieser Teil wurde somit eingestellt bzw. abgewiesen. Die verbleibende Klage wird Oxman nun vor dem eigentlich zuständigen state court, dem Los Angeles Superior Court einreichen.

Es klingt so, als wolle Oxman seine Klage mit der von K.J. eingereichten Klage gegen AEG verbinden. Hoffentlich weiß er, ob und wie dies umzusetzen ist!!!

Am Ende findet sich noch eine interessante Einschätzung des Richters, was die Dauer des Strafverfahrens betrifft. Nach seiner Ansicht wird das Verfahren gegen Murray 2 Jahre dauern.

Dr. Conrad Murrays Anwalt hat einen Antrag eingereicht, um Joe Jacksons Klage gegen ihn wegen fahrlässiger Tötung abzuweisen... hat TMZ erfahren. Murrays Anwalt, Charles Peckham, behauptet Joes Anwalt verpasste die Klagefrist und somit ist der Fall - mit Fokus auf den Tod von Michael Jackson - verjährt.

Peckhams Einwand: Joe's Anwalt, Brian Oxman, reichte die Klage 158 Tage nach der 1-Jahres-Frist ein.

Kenny Ortega was sued by Katherine, who claimed he was part of AEG's alleged plan to give Michael anything he needed in order for him to perform.
Katherine's lawyer, Kevin Boyle, tells TMZ, "Based on recently discovered information, the Jackson family has determined that Mr. Ortega should not be a defendant," adding, "The Jackson Family apologizes for any discomfort or inconvenience this may have caused Mr. Ortega."
It's always a discomfort to be sued for wrongful death.

Hätten sie sich mal vorher überlegen sollen. Sie haben doch miterlebt wie es jemandem geht, der fälschlicher Weise beschuldigt wurde. Ich glaube, das wird nicht ihre letzte Entschuldigung sein.

Ich stell mir grade vor...
AEG verklagt die Jacksons wg. böswilliger Verheimlichung der ihnen seit Jahren bekannten Tatsache, dass MJ ein hoffnungsloser druggie war, den sie mehrmals vergeblich versuchten vor sich selbst zu retten. Aber stattdessen habe man teilweise sogar spekuliert, selbst von dem geplanten Projekt profitieren zu können. Man habe MJ und AEG ins offene Messer laufen lassen.

Kenny Ortega is continuing his battle to be dropped as a defendant in Katherine Jackson's lawsuit against AEG, and RadarOnline.com has his detailed legal filing.

Ortega, the famed choreographer and director who was helming Michael Jackson's planned This Is It concert series, was named by Katherine Jackson as one of the people she believes is responsible for her son's death.






Nothing could be further from the truth, Ortega says and on January 26, he filed a Memorandum of Points and Authorities stating he was "wrongfully and mistakenly named as a defendant in this case."

Ortega, the document states "has been extremely hurt by this mistaken and misguided Complaint publicly naming him as a defendant allegedly responsible for his friend's death."

He's asking the court to remove him as a defendant in Katherine's ongoing lawsuit against the giant entertainment and sports presentation company, AEG.

Habe kürzlich ebenfalls stundenlang vergeblich danach gesucht.
Alle Informationen dazu sind wahrscheinlich in diesem Thread oder an anderer Stelle untergegangen

Ich würde es ja für sinnvoll halten, einen seperaten Thread zu eröffnen und dort alles diesbezügliche zusammen zu tragen, damit man weiß, wo man nachlesen oder anknüpfen kann.

Bezüglich deiner o.g. Information hatte ich nämlich vor kurzem gelesen, dass der Anwalt von Kenny Ortega dem Gericht einen Antrag gestellt hat, seinen Mandaten aus der Klage zu entlassen, weil er weder einen Vertrag mit Michael oder Dr. Murray gehabt hätte, noch bei AEG angestellt wäre.
Ich gehe daher davon aus, dass diesem Antrag nun stattgegeben wurde und der Sachverhalt hier zu Gunsten Katherines etwas verdreht ausgelegt wird oder ihre Anwälte der zu erwartenden Gerichtsentscheidung clevererweise auf diese Art vorgriffen.

Nachtrag: Entschuldigung für die teilweise Wiederholung, ich war etwas langsam !

Das ist alles eine Farce.

Das ist gar nicht zum Lachen, Christine!

Denn theoretischist es sogar durchaus vorstellbar, dass die Karten da für AEG gar nicht mal die schlechtesten wären.
Im Gegensatz zu unsicheren Fellower-Beschreibungen über Michaels körperliche Verfassung und vagen Aussagen über familiäre Interventionen gegen Michaels Medikamenteneinnahmen hätte AEG handfeste Nachweise vorzulegen.

Ob die unversöhnliche Tour gegen AEG, mit der Michaels Eltern ja gleich nach der Trauerfeier im Staples Center begannen, letztendlich nicht für nachhaltige Verärgerung und Verhärtung bei AEG gesorgt hat, bleibt abzuwarten.
Sicher haben die nicht weniger Presseausschnitte gesammelt als unser Newsman hier im Forum.
