MJs Arzt Dr. Conrad Murray, angeklagt wegen fahrlässiger Tötung, plädiert auf nicht schuldig und stellt sich einem Prozeß.
Der erste Prozeßtag wurde auf den 28. März 2011 festgesetzt, wo man mit der Auswahl der Jurymitglieder beginnen wird.
Die Verteidigung sagte, sie sei bereit innerhalb der gesetzlich festgelegten Frist von 60 Tagen die Verhandlung zu beginnen.
Die Anklagevertretung stimmte einer schnellen Terminansetzung zu.
Der Richter setzte für 7. Feb. 2011 eine mündliche Anhörung an, in der es darum geht, ob während des Prozesses Kameras in Gerichtssaal
erlaubt sein sollen.



LOS ANGELES — Michael Jackson's doctor pleaded not guilty Tuesday to a charge of involuntary manslaughter in the pop superstar's death as the case moved rapidly toward a trial that will likely be televised.

"Your honor, I am an innocent man," Murray told Superior Court Judge Michael Pastor in a soft voice. "I definitely plead not guilty."

Lawyers for Murray, who is accused of giving Jackson a lethal dose of the powerful anesthetic propofol and other sedatives, said they would be ready to go to trial within the 60-day statutory time limit, which would make for an unusually speedy trial.

Deputy District Attorney David Walgren said the prosecution would be ready to go as well. The judge scheduled the trial to begin March 28 and set a pretrial hearing for Feb. 7.

Dr. Conrad Murray hat für nicht schuldig plädiert. Er ist angeklagt, den King of Pop fahrlässig getötet zu haben. Fahrlässige Tötung wird als unbeabsichtigte Tötung ohne Bosheit definiert und wird mit einer geringeren Strafe als bei Mord gewertet.

"Euer Ehren, ich bin unschuldig. Ich bin plädiere daher für nicht schuldig ", sagte Murray zu Los Angeles Superior Court Richter Michael Pastor.

Richter Pastor hat den ersten Verhandlungstermin auf dem 28. März 2011 festgelegt. Eine mündliche Verhandlung soll es am 07. Februar 2011 geben, weil es noch offene Verfahrensfragen gibt, einschließlich einer möglichen Entscheidung darüber, ob Fernsehberichterstattungen über das Verfahren zugelassen werden.

In Kalifornien ist Murray die Approbation als Arzt abgenommen worden und er ist auf Kaution fei. "Dr. Murray hat seine Approbation in Texas und Nevada noch und er wird die Behandlung von Patienten dort fortsetzen bis es Änderungen gibt", sagte sein Anwalt Ed Chernoff.

Chernoff erzählte Reportern, dass Murray sich auf seine Darstellung der Geschichte freue, sagte aber, sein Verteidigungsteam hat noch nicht entschieden, ob der Arzt in seiner eigenen Verteidigung aussagen wird.

Obwohl es Murray befohlen wurde, vor Gericht zu erscheien, wenn die Auswahl der Jury am 28. März 2011 beginnt, wurde er von der Teilnahme am 7. Februar 2011 für die vorgerichtliche Anhörung entschuldigt und braucht dann nicht erscheinen.

Dr. Conrad Murray Trial, a Bitter Pill to Swallow

Brace yourself. It's starting again. The stage has been set for another legal drama featuring the King of Pop. Dr. Conrad Murray, Michael Jackson's personal physician, was arraigned on Tuesday morning in Los Angeles Superior Court. Stating, "Your honor, I am an innocent man," Murray pled not guilty to the charge of involuntary manslaughter in connection with the star's death. Jury selection for his trial is set to commence on March 28. If convicted, the maligned doctor could face a maximum of up to four years in prison.
Can anyone bear to watch Michael Jackson be dissected yet again in the court of public opinion? Fortunately, unlike the child molestation cases, there are socially prescient issues that will be addressed by a Dr. Conrad Murray trial. Issues that have the potential to generate useful policy discourse.
Michael Jackson will now be presented by the prosecution as the victim rather than the victimizer. This trial will unfold without the star ever having to personally defend his actions or perceived predilections. Instead, the focus will be on Dr. Murray, the man who was privy to Jackson's exclusive daily life leading up to precise moments of his death. Murray's attorneys will need to explain what exactly happened on June 25, 2009. Why did Michael Jackson die and who was responsible? The tables have turned, not out of vengeance brought by "crazy" Jackson fans, but by the law seeking truth where injustice has occurred.
Confident and seeking a speedy trial, Dr. Murray's defense team has already begun to draw their Michael Jackson portrait. Predictably, they will argue that he was a demanding, drug dependent pop star who was sick, suicidal and ultimately responsible for his own fate. Inevitably, certain media outlets will jump on this characterization with stories that blur the line between honest journalism and tabloid sensationalism. Of course, some will argue that every human being, including Jackson, should be held accountable for their personal decisions, actions and even their own death. But come on now! Let's not fool ourselves into believing that mantra is really the crux of this debacle.
While there are many actors in this story, the Michael Jackson tragedy is foremost a tale of the abysmal ethical choices, disastrous professional judgment and horrendous medical practices of a trusted caretaker. Dr. Conrad Murray exploited loopholes in the system, turned a blind eye, became sloppy, tried to cover up his mistakes and then got caught. It certainly could have ended differently.
Giving Murray the benefit of the doubt, perhaps he was working in the wrong place, at the wrong time and with the wrong man. The cash and Hollywood allure though were too seductive for him to resist. Dr. Murray's reputation, livelihood and career now hang in abeyance. Even if acquitted, what he will have sorely learned is that when playing carelessly with a raging fire, you are guaranteed to get scorched.
Hired in 2009 by concert promoters AEG to serve as Michael Jackson's personal physician, Murray was paid the exorbitant sum of $150,000 a month for his position. He was charged with caring for the star and ensuring that Jackson was healthy enough to attend rigorous rehearsals as he prepared for a comeback tour. That spring, Murray promptly closed his Houston and Las Vegas medical practices and moved to Los Angeles to care for the music legend on a full-time basis at his rented Holmby Hills mansion. What eventually developed turned out to be a highly destructive patient-physician relationship.
The Los Angeles County coroner's office determined that Michael Jackson died of acute propofol poisoning. A powerful surgical anesthetic which is only to be administered in a hospital, propofol was being given to Jackson in his home as a sleep aid to combat chronic insomnia. Dr. Murray has claimed that he was unaware of Jackson's propofol use prior to accepting his post and that he eventually became concerned the star was becoming addicted to the drug.
Despite glaring red flags and against his sound professional judgment, Murray continued to administer propofol to Jackson regularly during the two months leading up to and on the day of his death. He allegedly left Jackson unattended under the influence of the drug on that fateful morning, failed to properly resuscitate the star when he stopped breathing and then delayed calling 911, all while seeking to hide evidence. When help finally arrived, Murray did not inform medics that he had ever given Jackson propofol. Negligence?
According to witness testimony from Murray's preliminary hearing, the doctor also crossed clear ethical boundaries on a number of occasions during the time period when he was caring for the star. Such testimony revealed that Murray employed tactics of blatant misrepresentation to obtain excessive amounts of propofol and other sedatives from a Las Vegas pharmacy for Michael Jackson's use. Large quantities of these drugs were later found in Jackson's home after his death. Fraud?
If Dr. Murray believed that Michael Jackson was becoming an addict, why did he continue to administer potentially harmful and addictive drugs? If Dr. Murray was so concerned for Jackson's welfare, why didn't he proactively seek help from family members or handlers to stage an intervention on the star's behalf? Why didn't Dr. Murray just remove himself as Michael Jackson's physician? Whether or not Jackson demanded propofol, his "milk," is irrelevant in this case. Dr. Conrad Murray, a medical professional once licensed in three states, should have never given the drug to Michael Jackson.
The question of whether Murray was negligent in administering propofol to the pop icon will be the central legal issue in this case. However, this saga extends far beyond the universe of esoteric drug names, technical medical evidence and narrow interpretations of law. At its heart, it is a morality play ripe with classic, Shakespearean themes. The opiates of money and power, combined with the lust for celebrity and fame, drove a once respected member of the medical community to breach his responsibilities to his patient, his profession and ultimately to society. How did this happen?
Getting to the nut of the Dr. Conrad Murray case is going to be a dizzying affair. Enduring it though will possibly unearth a precedential jewel. Guilty or not guilty, it is highly questionable whether emotional justice will ever be served to the millions who seek it.
What can be the certain outcome of a Dr. Murray trial is that the legal system, the medical establishment and the public will begin to address some pressing policy questions. What are the acceptable parameters of the private patient-physician relationship? How can the fraudulent traf****ing of potentially lethal pharmaceutical drugs be stopped? Through what institutional mechanisms can proper standards of medical professional ethics and practice be effectively enforced? Michael Jackson would undoubtedly want an element of humanity and positive social change to come from this imperfect storm. That is its simple potential.

Gemäß einer Zeugenaussage aus der Voranhörung, überschritt der Arzt in der Zeit, als er sich um den Star kümmern sollte, ganz eindeutig mehfach klare moralische Grenzen .
Dieses Zeugnis offenbarte, dass Murrays angewandte Taktik der offenkundigen Verdrehung der Tatsachen dazu diente, Unmengen von Propofol und andere Sedative für MJs Gebrauch von der Las Vegas Apotheke zu beziehen.
Schwindel?

Wenn Dr Murray glaubte, dass Michael Jackson süchtig werden könnte, warum setzte er fort, potenziell schädliche und suchterzeugende Rauschmittel zu verwenden? Llyod's could escape a multi-million pound payout to the promoter of Michael Jackson’s tour

LLOYD’S of London insurers will escape having to make a multi-million pound payout to the promoter of Michael Jackson’s ill-fated comeback tour if the singer’s personal physician is convicted of involuntary manslaughter.

The insurance policy taken out by AEG, owners of the O2 Arena where Jackson’s 50-date This Is It concert series was to take place, stipulates that a payout would only occur if the singer failed to perform due to an accidental death.

In the event of Dr Conrad Murray being convicted, the syndicate of Lloyd’s insurers behind the policy will not have to pay a penny, sources say.

Earlier this month, a judge ruled that the cardiologist would stand trial in Los Angeles over the death of the pop legend in June 2009. It is alleged he gave Jackson a lethal dose of an anaesthetic, mixed with other sedatives and then failed to provide proper care.
If convicted, Murray could face up to four years in jail. He has pleaded not guilty.

Conrad Murray wird der Prozess gemacht - und die Welt kann zuschauen: Wenn der Leibarzt von Michael Jackson ab Ende März vor Gericht steht, werden TV-Kameras die Verhandlung übertragen. Das hat Richter Michael Pastor entschieden.

Los Angeles - US-Fernsehsender dürfen den Prozess gegen Michael Jacksons Leibarzt Conrad Murray zeigen. Richter Michael Pastor gab sein Einverständnis für TV-Kameras im Gerichtssaal - solange sie den Prozess nicht stören. Das berichtet der Sender CNN. Pastor verbot aber die TV-Übertragung bei der Auswahl der Jury-Mitglieder.

Pastor sagte, er wolle die "absolut unaufdringlichste Platzierung" der TV-Kameras im Gerichtssaal und habe sich detaillierte Vorschläge lokaler Fernsehteams angehört. Er hofft, dass TV-Sender bis zu einem weiteren Termin am 15. Februar einen vollständigen Übertragungsplan vorlegen, den er dann endgültig genehmigen kann.

Pastor legte den für Ende März geplanten Prozessbeginn nun auf den 24. März fest. Dann soll die Mitglieder der Jury ausgewählt werden. Bisher war vom 28. März als erstem Prozesstag ausgegangen worden.

Der Kardiologe Murray hatte im Januar in einer Anklage wegen fahrlässiger Tötung auf " nicht schuldig" plädiert. Im Falle einer Verurteilung drohen dem 57-jährigen Mediziner bis zu vier Jahre Haft. Prozessbeobachter gehen davon aus, dass das Verfahren bis zu sechs Wochen dauern kann. Nach der Klageerhebung hatte Murrays Anwalt Ed Chernoff gesagt, sein Mandant freue sich darauf, "seine Seite der Geschichte zu erzählen".

Richter Pastor hatte Mitte Januar nach einer sechstägigen Anhörung entschieden, dass die Beweislast gegen Murray einen Prozess rechtfertigt. Er verhängte auch ein sofortiges Berufsverbot gegen den Herzspezialisten. Murray darf seitdem in Kalifornien nicht mehr praktizieren. Dies gilt aber nicht für Nevada und Texas, wo er noch Patienten hat.

Dr. Conrad Murray, whose involuntary manslaughter trial starts next month, has hired a new lawyer for his legal team.

Los Angeles lawyer Nareg Gourjian will assist lawyers Ed Chernoff and J. Michael Flanagan in defending Murray, who is charged in pop star Michael Jackson's death.

A document filed in Los Angeles County Superior Court on Monday said Gourjian is replacing Joseph Low, who is leaving the Murray defense team.

Gourjian is a former of associate of Mark Geragos, a lawyer known for high-profile criminal cases. He helped Geragos with those cases, including Chris Brown's domestic violence charge and the trial of Scott Peterson, who was convicted of killing his wife.

Gourjian currently represents Joe Finley, an "America's Got Talent" prospect whose wife was found dead last fall at a Los Angeles hotel.

Murray is accused of killing Michael Jackson in June of 2009 with an overdose of the anesthetic propofol.

The defense lawyers and prosecution will meet for a hearing Tuesday to discuss discovery motions and other issues as they prepare for the start of jury selection on March 24.

Judge Michael Pastor ruled last week that the trial can be televised.

Michael Jackson's Ex-Lawyer Considering Asking Judge To Remove Dr Conrad Murray's New Attorney From Case

The lawyer who won Michael’s Jackson’s acquittal on child molestation charges is considering asking a Los Angeles judge to stop another attorney from being added to the legal team of the pop star’s former doctor, who is facing charges of involuntary manslaughter.

Nareg Gourjian is joining forces with Conrad Murray’s lawyers Ed Chernoff and Michael Flanagan, who are preparing to defend the doctor at trial, beginning on March 24.

Gourjian is a former of associate of Mark Geragos, a lawyer known for high-profile criminal cases, including Chris Brown's domestic violence charge and the trial of Scott Peterson, who was convicted of killing his wife.

Herein lies the problem, as RadarOnline.com has learned.

Gourijian was also an associate of Geragos' law firm and worked on Jackson’s successful defense during the late singer’s infamous 2005 trial, where he stood accused of seven counts of child molestation and two counts of administering an intoxicating agent to a 13-year-old male.

Gregaros is so concerned that a former member of his team, who was privy to the King of Pop’s personal information, is now working to defend the man accused of killing him.

“Mark is concerned about the conflict of interest because Nareg worked on Michael's molestation defense,” the source told RadarOnline.com.

“Nareg was privy to details about Michael Jackson's life that were never made public.

“This is very, very bothersome to Geragos.

“Mark is considering filing paperwork with Los Angeles Superior Court Judge Michael E. Pastor stating he believes there is an obvious conflict of interest.

“Nareg knows that Mark is concerned about this."

Murray is accused of responsibility for the pop icon's death on June 25, 2009 by administering an overdose of the powerful sedative Propofol, with which Jackson was being treated to help him to sleep.

There is a pretrial hearing in Dr. Conrad Murray's case this afternoon, but the embattled doctor won't be there.

Geragos could appear in person at the hearing to detail his concerns to Judge Pastor.

The judge handling the trial of Michael Jackson’s physician expressed concern Tuesday that the doctor recently hired a lawyer who once worked for a firm that defended the pop star from child molestation charges.

Los Angeles Superior Court Judge Michael Pastor said at a hearing Tuesday that he was worried about a possible conflict of interest and would seek input from Jackson’s estate before ruling.

Gourjian said he was a junior associate who had “minimal” involvement in the Jackson defense and said, “There is no conflict.” The singer changed lawyers before trial.

The defense gave the prosecution a list of more than 90 potential witnesses. The prosecution has already turned over a list of more than 100 names.

Murray could face four years in prison if convicted.

Possible conflict of interest delays new lawyer for Dr. Murray

The judge delayed a decision on allowing a new lawyer to join Dr. Conrad Murray's defense team until he can determine if there is a conflict of interest.

The lawyer, Nareg Gourjian, had worked on Michael Jackson's child molestation defense.

Murray, who is charged with involuntary manslaughter in the death of Michael Jackson, wants Gourjian to replace Joseph Low, who left the defense team earlier this month.

Gourjian's former law firm, headed by lawyer Mark Geragos, raised the possible conflict of interest before Los Angeles County Superior Court Judge Michael Pastor at a hearing Tuesday.

"We have a great amount of respect for Mr. Gourjian, but it is our duty to disclose his participation in our past representation for Mr. Jackson," Geragos and Geragos attorney Pat Harris said.

The Geragos firm represented Jackson for two years starting in 2003, when he was charged with child molestation. Jackson replaced Geragos with Thomas Mesereau in 2004, saying he wanted an attorney who would devote his full time to his case.

Geragos was also defending Scott Peterson, who was charged with murdering his wife, at the same time.

Gourjian told the judge he was "in no way inolved" in the Jackson case because he was "a brand-new lawyer" busy working on the Scott Peterson murder case at the time.

The decision rests on if Gourjian's work for Jackson was "substantially related" to the current case and if his work for the defense would require "Gourjian to attempt to discredit his former client directly or indirectly," Pastor said.

The judge delayed a decision until more facts are provided by Geragos and there is a response from the lawyer for Michael Jackson's estate.

Mark Geragos will be asked to appear at the next hearing on February 24, the judge said.

Murray is also represented by Houston lawyer Ed Chernoff and J. Michael Flanagan of Los Angeles.

The defense demanded a speedy trial at last month's arraignment, the trial to start by the end of March. Jury selection is now set for March 24.

Auch nach der gestrigen Anhörung zeigte sich der Richter empört insbesondere über die mangelnde Einbringung von Prozess/Zeugenmaterial zur Vorbereitung für den Prozess von Seiten der Verteidigung. Der Richter drohte erneut mit finanziellen Sanktionen, Prozessverschiebung und Ausschluss von Zeugen. Zwar reichte die Verteidigung über 500 Seiten an Material ein. Davon wären aber über 300 Seiten nicht prozessrelevant. Für Mittwoch 2 p.m. ist nun die nächste Anhörung angesetzt zu dem er auch Murray einbeordert hat. Der Richter forderte auf das bis dahin alles einzureichen ist. Beide Staatsanwälte forden die Verschiebung des Prozesses. Flanagen meinte noch, das Ganze sei keine Einbahnstraße auch die Staatsanwaltschaft hielte mit Material zurück.

Saying he was concerned about the sharing of evidence among attorneys, a Los Angeles judge today threatened to penalize lawyers in the criminal case against Dr. Conrad Murray, who is charged with involuntary manslaughter in connection with singer Michael Jackson's death.

During a pretrial hearing, Los Angeles Superior Court Judge Michael Pastor told defense attorneys and prosecutors he was disappointed in persistent complaints from both sides about lawyers failing to share evidence.

``I want to emphasize I am considering very seriously the imposition of monetary sanctions at this point,' Pastor told the lawyers.

The judge's comments were aimed at both prosecutors and defense attorneys, but he said specifically he was ``disappointed' at what he has been hearing about the lack of defense evidence being shared with prosecutors.

Pastor scheduled another hearing for 2 p.m. Wednesday, and he ordered that Murray and his lead attorney, Ed Chernoff, attend.

The judge noted that he did not want to punish Murray, but said he was considering penalties ranging from fines of $1,500 per day per lawyer, a possible delay in the scheduled March 24 trial date, inclusion of jury instructions in the case about ``tardy discovery' and -- as a last resort -- preclusion of some witnesses from testifying.

``I seriously am considering all sorts of responses to the discovery situation,' the judge said.

During the hearing, Deputy District Attorney Deborah Brazil said defense attorneys turned over 526 pages of discovery last week, but 380 of them involved probate issues, and she was unclear of their relevance to the case.

Defense attorney J. Michael Flanagan, however, complained that prosecutors were also failing to share evidence, calling the flow of information a ``one-way street.'

Pastor demanded that the attorneys make serious improvement in communication before Wednesday.

``I expect a dramatically increased production of discovery between now and then,' he said.

Both prosecutors in the case have asked that the March 24 trial date be pushed back. Pastor has not ruled on the motion, saying today that the District Attorney's Office would need to provide some case law to back up their request.

(Mar 1) Lawyers representing DR. CONRAD MURRAY have urged a judge not to delay the upcoming involuntary manslaughter trial into MICHAEL JACKSON's death - because they "don't have the budget" for lengthy court proceedings.
The medic stands accused of administering the drug Propofol which killed the King of Pop in June 2009.
The case is scheduled to begin on 24 March (11), but Los Angeles Superior Court Judge Michael Pastor could push back the start date of the trial after prosecutors called for a later hearing, according to the Associated Press.
Speaking on Monday (28Feb10), he said, "I am extremely distressed about the state of this case and whether the defense is prepared for trial and its obligations to Dr. Murray."
But Murray's legal team have appealed to Judge Pastor to keep 24 March as the start date - as they are running out of cash.
Defense attorney J. Michael Flanagan pleaded, "We need to go to trial right away. We don't have the budget that would let us draw this out."
Reports suggest prosecutors are objecting to the trial start date because they are entitled to receive discovery of defense evidence 30 days before trial starts - a deadline which has already passed. The judge threatened Murray’s lawyers with hefty fines for failing to share evidence with prosecutors.
He told the attorneys for the pop icon’s personal physician that he would impose the fines or other sanctions on Wednesday (02Mar11) unless they met their legal obligation to turn over witness statements and expert reports to prosecutors.
Meanwhile, the judge has ordered Deputy District Attorney David Walgren to turn over digital photos from Jackson's autopsy as well as all of the surveillance tapes recorded at his home on the day he died.
