    Im Kreuzverhör von Murray Verteidiger Ed Chernoff, versuchte dieser die Theorien von Propofol Experte Dr. Steven Shafer zu untergraben. Chernoff fragte Shafer, ob er den Unterschied einer Meinung und einer Tatsache kenne. Die Behauptung, dass sich Michael weder mit Lorazepam noch mit Propofol hätte selbst umbringen können, bezeichnete Chernoff als ein “gewagtes Statement, ist es das nicht?”. Shafer antwortete: “Ich denke das ist, was passiert ist.”
    Chernoff bezweifelte Shafers Simulierung, die ergab, dass Michael Jackson 10 Dosen Lorazepam intravenös verabreicht bekam. Gemäss Shafers Berechnung wurde die erste Dosierung etwa um Mitternacht des 24. Juni verabreicht. Chernoff machte darauf aufmerksam, dass Michael Jackson erst etwa um 1 a.m. von den Proben nach Hause kam. Chernoff kritisierte auch Dr. Shafers Demonstration, wie Murray seinem Patient das Propofol verabreicht haben könnte. Shafer habe dabei nicht die gleichen Gegenstände, die in Michael Jacksons Schlafzimmer gefunden wurden, verwendet. Und dass der gezeigte Infusionsschlauch nicht gefunden wurde. Shafer konterte, dass er die Grösse der Gegenstände nicht relevant fände, und dass Murray den Infusionsschlauch problemlos in seine Jackentasche hätte stecken können, bevor er das Schlafzimmer verliess. Chernoff fragte Shafer auch über seine Beziehung mit Dr. Paul White (der Propofol Experte der Verteidigung). Ob es wahr sei, dass er Dr. Paul White für einen Excellence In Research Award nominiert habe. Shafer bejahte.

    In einer Pause fragte Richter Michael Pastor den Propofol Experten der Verteidigung, Dr. Paul White, der auch im Gericht anwesend war, ob es wahr sei, dass er gegenüber einem Reporter von E! News während einer Gerichtspause am Donnerstag über Staatsanwalt David Walgren sagte: “Was für ein Mistkerl.” White bestritt dies, anerkannte aber andere Statements, die in dem online-Artikel vorkamen. “Ich war sein Lehrer als er ein Medizin-Student war. Die Wahrheit wird herauskommen. Wie immer”, sagte White dem Reporter. Richter Michael Pastor wies in der Folge erneut darauf hin, dass mit niemandem über den Fall gesprochen und keine Infos ins Internet gestellt werden dürfen. Da Dr. White dagegen verstossen hatte, muss er am 16. November vor Gericht erscheinen hinsichtlich einer möglichen Sanktion.
    Am Donnerstag kritisierte Dr. Steven Shafer vor Gericht einen Report von Dr. Paul White für die Verteidigung, in dem er schrieb, dass es möglich sei, dass Michael Jackson Propofol getrunken habe. Shafer sagte im Gerichtsaal, dass er über den Bericht seines langjährigen Freundes und Fachkollege enttäuscht sei, da bereits Medizinstudenten im ersten Jahr erste Prinzipien lernen, die folgern lassen, dass Propofol zu trinken keine Wirkung haben kann. Shafer erwähnte dazu Studien. Auch die Verteidigung prüfte die Theorie vom Propofol trinken und kam zum gleichen Resultat, worauf sie die Behauptung, Jackson habe Propofol getrunken, fallen liessen.

      Dr. Shafer Testimony continued

      Hearing starts with 221 - A stipulation . The term "tab handle" on Propofol bottleis defined.

      Walgren direct continued

      Walgren asks if Shafer reviewed 8 page toxicology report by the coroner. Shafer says yes and that it showed pure true level of drugs , it doesn't include the metabolites. Shafer evaluated the procedures that is used by the coroner.

      Shafer mentions that he made his simulations available to the defense and volunteered to help

      Walgren asks if dying eyes open mean anything. Shafer says it doesn't mean slow or quick death.

      After Walgren's question Shafer says it's a possibility that MJ woke up and manipulated the infusion line and that would mean CM left MJ alone. Shafer also wrote this in his report.

      Walgren asks if this had happened would Shafer's opinion change about CM. Shafer says no and even if MJ woke up and opened the rubber clamp, it will still be CM's responsibility and CM wasn't available and let this happen. It's still considered abondonment.


      Chernoff cross

      Chernoff goes over what Dr. Shafer does and his models. Shafer can determine concentration from dosage. Shafer says he usually knows what dose is given.

      Shafer says that as people are different his models are built to give ranges. The median is the representative of the half of the people's response to a particular drug.

      In this case Shafer only had the concentration and he had the calculate the dose from the concentration.

      Chernoff mentions that there was only one IV line found at the scene. Chernoff asks if Shafer's theory of what happened is a bold statement. Shafer responds as he believes it to be an honest statement.

      Chernoff asks if there's any particular reason Shafer brought a different IV line for the saline bag. Shafer contacted Sea Coast medical to get theexact line but the shipping would have taken 2-3 weeks so he brought the other line. Chernoff shows the exact IV line to Dr. Shafer. (The IV line Chernoff shows is dirty and has brown stuff on it. Shafer wonders if it's blood, Chernoff says it's not).

      Chernoff then asks why Shafer brought a vented IV line for the Propofol. Shafer says that a vented line is needed to get Propofol out. Chernoff asks why Shafer assumed CM used that IV line. Shafer says that SeaCoast reports shows that Murray ordered that line and it shows he intended to use it.

      Chernoff asks how Shafer could know if CM used it in MJ's room. Shafer says because he needed a vented IV line. Shafer says the bottle had a spike tear but there was no needle hole in the Propofol bottle. If there had been a needle hole, CM could have used another IV tubing. Shafer says that as this bottle only had a spike tear, there had to be a vented IV line. Shafer says that this is the only vented IV line he saw in CM's orders and he had it shipped to California.

      Chernoff says perhaps there was no tubing at all. Shafer responds how would you draw the Propofol then? Chernoff says that LAPD did not find a vented line. Shafer says it's easy to hide and take with a person. Chernoff asks why wouldn't a person also take the bottle and the needles. Shafer says that needles can hurt and bottles are bulky.

      Chernoff tries to emphasize that this is all Dr. Shafer's opinion. They discuss back and forth about what's an opinion. Shafer says what he says is based on medical knowledge and some are facts and some are his opinions. Shafer says "It's my opinion that one should not lie to UCLA doctors".

      Chernoff mentions that CM said that he used a 10cc syringe but Shafer used a 20cc syringe. Shafer says the size of the syringe was irrelevant. Chernoff again goes over that Shafer used a different IV tubing for saline bag, a different shape Propofol bottle and a larger syringe. Shafer answers yes. Chernoff asks about the tear on the saline bag. Shafer says it peaked his interest and he bought 3 IV bags for $150 and estimated the tear on the bag.

      Chernoff mentions that Walgren called Shafer on March 31st and then sent him statements and reports. Chernoff goes over Dr. Shafer's report and that he used "might" to describe what happened. Shafer also referenced Alberto Alvarez's statatement and that he saw a propofol bottle in a bag. Chernoff asks if Shafer ever met or talked with AA and if he made the assumption that AA was telling the truth.

      Chernoff says that the handle on the 100ml Propofol bottle found on the scene was not used. Shafer says it's irrelevant and that whether the bottle was in the bag or hung on the pole it wouldn't make a difference. Chernoff asks if it's reasonable that rather than hanging the Propofol bottle by the handle, CM would go all the steps to empty and cut the bag and put the propofol bottle inside it. Shafer says it's reasonable.

      Chernoff says that CM is on trial for his life and there's a sidebar.

      Chernoff asks about the medical malpractice lawsuit that Dr. Shafer testified 10 years go and if he didn't like the doctor in that case. Shafer says he didn't like the doctor. Shafer says he testified once before but he consults on trials twice a year.

      Chernoff goes over Dr. Shafer's resume. When Shafer was a medical student at Stanford University, Dr. White was an assistant professor in anesthesia. Shafer published papers with Dr. White. Shafer wrote the software and helped with mathematical models for Dr. White's study in 1888.

      Chernoff goes over the Propofol insert and asks Shafer to show which parts was his contribution. Shafer circles and underlines the parts he did.

      Chernoff goes over other studies / articles and books Dr. Shafer worked on. Chernoff mentions the work Shafer and White did together. Shafer and White has known each other for almost 30 years and in 2009 Shafer nominated White for an award.

      Chernoff mentions Dr. Shafer's statement when he said "he was disappointed" with White about saying oral consumption. Shafer says he was disappointed and that's how he felt. Chernoff asks if Shafer knows this trial is on TV and shown internationally. Walgren objects. Chernoff asks if Shafer knows the circumstances of the letter Dr. White sent to Flanagan and that it was rushed in 2 days due to threats of contempt. Objection and Sidebar.

      Chernoff talks about Propofol found in MJ's stomach. Shafer sent the piglets study to Walgren and told Walgren there's was no human study. Shafer then contacted Chilean professors for the human study but Walgren didn't ask for that study.

      Chernoff says that defense paid for a study on beagles and White did that study.

      Chernoff asks who paid for the Chilean study. Shafer says he paid $600 for the propofol and the students volunteered. The study was also presented in an international conference. Chernoff asks why would he do a 2 month student, write a paper and present it at a conference if Propofol not being orally bio-available was something that 1st year student will know. Shafer says it's better to have human data because it's not ambiguous and there would be no question about humans.

      During questioning we learn that Dr. Shafer himself swallowed 20 ml Propofol before he did the study.

      Chernoff asks if Shafer knew White wouldn't say MJ swallowed Propofol. Shafer says he didn't and stull doesn't know what Dr. White is going to say.

      Chernoff shows the 40 mg Lorazepam graph. Shafer says that it shows repeated bolus injections (10 injections) for every 30 minutes frim midnight till 5 AM. Chernoff says in his model the first shot was at midnight but MJ was still at rehearsal then. Shafer offers to do another simulation.

      Chernoff asks why he removed the "responsive to painful stimulus" , "not responsive to painful stimulus" lines from his graphs. Shafer says he wanted to make it as easy as possible for the jurors.

      Chernoff says based on his simulation MJ would be sleeping from 2:30 AM to 11:00AM. Shafer says as MJ was exposed to benzos for 80 nights, it's impossible to predict MJ's reaction to Lorazepam. Chernoff asks how he knows MJ had benzos for 80 nights. Shafer answers based on Murray's statement and pharmacy orders. Chernoff says that benzos being bought doesn't mean that they are used. Shafer says that he stand by his statement that says "information suggests a higher dose possibly 40 mg".

      Chernoff asks if Shafer did a simulation for oral Lorazepam. Shafer didn't do a simulation for it. Chernoff asks Shafer to tell what happens if a person swallow a tablet. It goes to the stomach, half of the pill absorbtion is in 22 minutes, it would then go to the liver subject to first pass, it would have 92% bioavailability and then it would go to the blood and to the tissues and brain. Metabolite would go to the bile and to intestines and stomach. The process is same for the IV lorazepam as well.

      Chernoff shows a graph that combines 2 injections of 2mg Lorazepam injections and 40 mg dose graph. Chernoff and Shafer goes over that MJ could not have swallowed Lorazepam in his last 4 hours.

      Chernoff mentions the Midazolam simulation and the numbers match to what CM said he gave.

      Chernoff shows the 25mg Propofol injection graph and another graph that Shafer did for White. This second graph shows 25 mg being given over 5 minutes. Shafer says the induction dose is given over 2 minutes because it's less painful to the patient.

      Chernoff asks what's the danger of a rapid infusion. It's apnea.

      Chernoff tries to go over the graph using the blood level, Shafer says he need to look to brain levels. Chernoff asks what was MJ's brain concentration of propofol. There was no measurement for that in coroner's report.

        Janet Jackson hat 3 Konzerte in Australien gecancelt um diese Woche am Prozess teilzunehmen. Sie hatte in der ersten Woche mit einigen Geschwistern teilgenommen und war danach 3 Wochen abwesend. "Nachdem ich gestern mit meiner Familie sprach entschieden wir, dass wir nun zusammenstehen müssen".

        Die Verteidigung will 15 Zeugen berufen, darunter 3 medizin. Experten, 1 Polizeimeister und verschiedene Patienten von Murray. Als einer der 1. Zeugen wird R. Phillips im Zeugenstand erwartet. Murray`s Verteidigung argumentiert Philipps habe Jackson unter Druck gesetzt, dass er gesund und fit zu den Proben erscheint, sonst werden die Konzerte gecancelt.

        Los Angeles (CNN) -- With the involuntary manslaughter trial of Michael Jackson's doctor entering what could be its last week, Janet Jackson canceled shows in Australia to be with her family in Los Angeles.

        Dr. Conrad Murray's lawyers will use the next four days to challenge the prosecution's contention that his reckless use of the surgical anesthesia propofol to help Jackson sleep makes him criminally responsible for the pop icon's death.

        Janet Jackson sat with her parents and several siblings during the first five days of the trial, but she has not been at court in nearly three weeks.

        "After talking with my family last night, I decided we must be together right now," she said in a statement posted Sunday on her website, announcing that three shows this week in Melbourne are canceled.

        The concert promoter told Jackson fans it was "important that Janet is with her family at this critical point in the hearing."

        If her flight arrives in Los Angeles before Monday morning, Jackson may see the last hours of the prosecution's key witness, anesthesiologist expert Dr. Steven Shafer.

        The defense cross-examination of Shafer grew so heated and personal Friday that the judge called lawyers for a sidebar and ordered them to "cut it out!"

        Murray defense goes on offensive The defense is expected to begin presenting its case later Monday.

        Murray's lawyers have said they plan to call about 15 witnesses, including three medical experts, a police officer and several of Murray's patients from his clinics in Las Vegas, Nevada and Houston.

        Randy Phillips, the head of AEG Live, is set to be among the first witnesses the defense calls.

        Murray's lawyers have argued that Jackson was pressured by Phillips, whose company was promoting his comeback concerts in London, to show up healthy and on time for rehearsals or else the tour might be canceled.

        Murray told detectives Jackson begged for his "milk," his nickname for propofol, after a sleepless night and just hours before he died from what the coroner said was an overdose of the surgical anesthetic.

        Murray, in a police interview, said he was using sedatives to wean Jackson from propofol, which he had used almost every night for two months to fight his insomnia. But after a long, restless night and morning, the lorazepam and midazolam had no effect, Murray said.

        "I've got to sleep, Dr. Conrad," Murray said Jackson pleaded to him. "I have these rehearsals to perform. I must be ready for the show in England. Tomorrow, I will have to cancel my performance, because you know I cannot function if I don't get to sleep."

        Murray said he gave into Jackson's pleas and gave him an injection of 25 milliliters of propofol at about 10:40 a.m.

        Shafer testified last week that there was no way Jackson got only that amount of propofol, based on the high level of the drug found in blood taken during his autopsy.

        The "only scenario" to explain Jackson's death was that he overdosed on propofol infused through an IV drip set up by Murray, Shafer said.

        The Los Angeles County coroner ruled that Jackson's death was a homicide, the result of "acute propofol intoxication" in combination with sedatives.

        The defense contends Jackson self-administered the fatal dose, along with sedatives, without Murray knowing.

        Shafer said the level of propofol in Jackson's blood taken during his autopsy could not have been from either Murray or Jackson injecting the drug, but only from an IV system that was still flowing when his heart stopped.

        Prosecutors, however, opened the door for one scenario in which Jackson, not Murray, could have triggered the overdose.

        "Can you rule out the possibility that Michael Jackson manipulated something to cause it to flow?" Deputy District Attorney David Walgren asked Friday.

        "That's a possibility," Shafer said. But that is assuming Murray set up the drip and left Jackson's side, he said.

        Would Shafer's opinion that Murray was responsible for Jackson's death change if he knew Jackson turned the drip on?

        "No, if Michael Jackson had reached up, seen the roller clamp and opened it himself, this is a foreseeable consequence of setting up an essentially dangerous way of giving drugs," Shafer said. "It doesn't change things at all. It would still be considered abandonment."

        Defense lawyer Ed Chernoff cross-examined Shafer about the assumptions he used to reconstruct an IV drip system he believed Murray set up next to Jackson's bed. Shafer demonstrated the system in his testimony Thursday.

        Jackson died because Murray failed to notice that his patient had stopped breathing while he was hooked up to an IV drip of propofol, Shafer testified. The doctor should have realized Jackson had stopped breathing, he said.

        "When you're there, you see it, you know it," Shafer said.

        Phone records and testimony showed that Murray was on the phone with one of his clinics, a patient, and then a girlfriend about the time that Shafer calculated the oxygen in Jackson's lungs became depleted, causing his heart to stop beating.

        "Had Conrad Murray been with Michael Jackson during this period of time, he would have seen the slowed breathing and the compromise in the flow of air into Michael Jackson's lungs, and he could have easily turned off the propofol infusion," Shafer said.

        Toxicology studies of drugs in Jackson's blood and computer models Shafer used to analyze how the singer died were overshadowed Friday when Chernoff focused on the personal and professional rivalry between Shafer and Dr. Paul White, the defense anesthesiology expert.

        The experts first met in 1978 when White was an assistant professor at Stanford University and Shafer was a medical student. They became friends and co-authored research papers, but this trial appears to have changed their friendship.

        Chernoff accused Shafer of wanting to "shove it down his (White's) professional throat" in a question stricken from the record by Los Angeles County Superior Court Judge Michael Pastor.

        White, who has been sitting in the courtroom listening to Shafer's testimony, was lectured by Judge Pastor about comments about Shafer attributed to him in an online blog.

        White admitted Friday that he told a reporter that he had changed his opinion of Shafer after hearing his testimony Thursday. "The truth will come out. It always does," E! News Online quoted White as saying.

        White denied calling Shafer "a scumbag," as the website quoted him as saying.

        Pastor, who imposed a gag order on all parties in the trial, set a contempt of court hearing for White next month.

          Tempers erupt in Jackson doctor trial

          Lawyers for Conrad Murray have dramatically challenged a key prosecution witness over his claim that the doctor was responsible for the death of Michael Jackson.

          Dr Steven Shafer has testified that the only plausible explanation for Jackson's death was that he had been hooked up to a drip of the anaesthetic propofol, then left alone by Murray.

          In cross examination, Murray's lawyer Ed Chernoff asked Dr Shafer: 'That's a bold claim, isn't it?'

          Dr Shafer replied: 'It's an honest statement.'

          Mr Chernoff also questioned the Columbia University researcher and professor about his demonstration of IV equipment for jurors on Thursday.

          He suggested Dr Shafer had drawn conclusions that were not necessarily supported by the evidence.

          In a bad-tempered exchange, Mr Chernoff asked Dr Shafer if he understood the difference between opinion and fact.

          Mr Chernoff asked: 'You understand everything you said in the last few days was an opinion, right?'

          Dr Shafer replied: 'I think I stated my name, which is a fact.'

          Earlier Dr Shafer had admitted it was possible Jackson had opened a clamp to release a dose of drugs into the IV line but that Murray would still be responsible for not staying with his patient.

          Murray has pleaded not guilty to involuntary manslaughter. He faces up to four years in prison and the loss of his medical licence if convicted.

          He had been Jackson's personal doctor as the star prepared for a series of comeback concerts at London's O2 arena. He was with Jackson when he suffered a fatal cardiac arrest in June 2009.

          Dr Shafer, an expert on propofol, told jurors earlier this week that his explanation was supported by items found in Jackson's bedroom, the singer's post-mortem examination results and Murray's lengthy statement to police.

          In a separate development, outside of the presence of the jury, judge Michael Pastor has ordered the defence's own propofol expert to face a hearing over whether he breached a court gagging order by speaking to a reporter.

          Dr Paul White, who has known Dr Shafer for 30 years, was reported to have criticised both him and the prosecutor David Walgren while speaking to a TV network.

          The defence is expected to call its first witness on Monday as the trial enters its fifth week.

            Michael Jackson’s doctor’s defense case expected to begin after prosecution expert questioning

            LOS ANGELES — Defense attorneys for the doctor charged in Michael Jackson’s death are expected to begin calling witnesses in their case Monday after they finish grilling a key prosecution expert.

            The defense case will be Dr. Conrad Murray’s opportunity to counter four weeks of damaging testimony about him from 33 prosecution witnesses who have cast him as an inept, distracted and opportunistic doctor who repeatedly broke legal, ethical and professional guidelines.
            The defense case is expected to comprise of 15 witnesses, although Murray’s attorneys have not publicly revealed whether they will call the Houston-based cardiologist to testify on his own behalf. Jurors have heard from the doctor through a more than two-hour interview with police, and it seems unlikely that Murray’s attorneys would subject their client to what would be blistering questioning from prosecutors.

            Monday will begin with lead defense attorney Ed Chernoff questioning Dr. Steven Shafer, the prosecution’s final witness and an expert in the anesthetic propofol, which Murray had been giving Jackson as a sleep aid. Chernoff’s questioning on Friday challenged Shafer’s conclusions and comments he had made about colleague Dr. Paul White, who will testify for the defense team.
            So far, Shafer has not retreated from his position that Murray is solely responsible for Jackson’s death and that the cardiologist committed 17 egregious violations of medical practices that each could have either led to Jackson’s serious injury or death.
            After Shafer is done testifying, Murray’s attorneys will likely ask a judge to dismiss the involuntary manslaughter case against the cardiologist. Superior Court Judge Michael Pastor will rule on the oral motion immediately and if he rejects it, the defense case will begin.

            Defense attorneys have said they will call police detectives who prosecutors did not call, several character witnesses, White and possibly other experts. They expect their case will last through Thursday.

            Murray has pleaded not guilty, and faces up to four years behind bars and the loss of his medical license if convicted.

            The defense will have its work cut out for them to try to sway jurors to acquit Murray.

            “He will have to change the landscape here and show some reasonable doubt, said Marcellus McRae, a former federal prosecutor and trial attorney who has been following the case closely. “The question is will this be enough.”

            McRae said calling Shafer as the prosecution’s final witness was a master stroke.

            “Brick by evidentiary brick, Shafer has built a wall of scientific reasons for the jury to conclude that Dr. Murray was criminally negligent,” he said. “It allows the prosecution to tell the jury that their case is built on science rather than shifting theories.”

            Out of sight of the jury, the defense’s theory has shifted in recent months from arguing that Jackson swallowed propofol and gave himself the fatal dose and more recently that the singer had swallowed several pills of the sedative lorazepam, which led to his death.

            They may also argue that Jackson somehow gave himself a shot of propofol after Murray left the room, killing him quickly.

            Prosecutors have sought to discredit all those theories through Shafer, who himself drank propofol before the trial in an attempt to confirm that it wouldn’t induce sedation or other ill effects. He called the amount of lorazepam in Jackson’s stomach “trivial” and last week said the only possible explanation for Jackson’s death based on the evidence was that Murray put the singer on IV drip of propofol and left the room after the singer appeared to be asleep.

            This week, it will be the defense’s turn to either offer alternate theories or somehow pick apart the prosecution’s case.

              Shafer hat seine Simulationen und die dazu gehörenden Programme auch der Verteidigung zur Verfügung gestellt und der Verteidigung seine Hilfe angeboten? - Ja.
              Worauf deuten offene Augen bei einem Verstorbenen hin? - Weder auf einen schnellen, noch auf einen langsamen Tod. Das hat nichts zu sagen.
              Auch wenn MJ am Tropf hing. Hätte er aufwachen können und sich trotzdem noch etwas verabreichen können? - Ja.
              Das würde aber auch bedeuten, dass CM ihn vernachlässigt und alleine gelassen hätte? - Ja.
              Shafer: Wenn CM dieses Setting aufgebaut hat und MJ hätte dann am Tubing selber noch etwas manipuliert, z.B. dass es schneller tropft, ist CM trotzdem schuld, da unsachgemäße Verabreichung.
              Cross-Examination Chernoff

              Zunächst sei gesagt, dass Chernoff bisher nur sehr wenig 'Angriffspunkte' bei Shafers Zeugenaussage fand. Er versuchte also eher, Shafer als Menschen darzustellen, der seinen Kollegen Dr. White (dem er karrieretechnisch vieles zu verdanken hat) vor den Augen der Öffentlichkeit diskreditieren will.
              Außerdem will er Shafer wohl, wie auch alle anderen Zeugen der Anklage, zunächst verwirren. Shafer berichtigt ihn aber sofort, sobald Chernoff ihm Worte in den Mund legt oder seine vorherige Zeugenaussage falsch widergibt.

              Dosierungen sind immer wichtig, egal wie die Medikamente aufgenommen werden? - Ja.
              Shafers Computerprogramm ermitteln üblicherweise die Blutkonzentration und deren Auswirkungen anhand einer vorgegebenen Dosis? - Ja.
              Hier war es aber umgekehrt. Dosierungen waren nicht oder nur unzulänglich bekannt. - Ja.
              Shafer brachte die medizinischen Sachen (IV Set) zur gestrigen Demonstration selber mit und bezahlte sie auch. Chernoff fragte, warum er gerade diese IV Line gekauft hat? - Weil die von Seacoast Medical (wo CM bestellt hatte) keine andere schicken konnte, es hätte zu lange gedauert.
              Chernoff hat auch eine Line bestellt und konnte sie aber so schnell geliefert bekommen.
              Ohne ein 'vented IV set' (ein IV Set ohne Luftzufuhr) kann man Propofol über den IV Schlauch nicht verabreichen? - Nein.
              Chernoff: CM hat viele Male diese Line bestellt und sie nicht nur an eine kalifornische Adresse liefern lassen. Shafer kann doch nicht davon ausgehen, dass diese IV Line für MJ bestimmt war, nur weil sie mal nach Californien geliefert wurde.
              Im Folgenden reitet Chernoff auf dem Unterschied zwischen 'Meinung' und 'Fakt' herum. Er will von Shafer hören, dass dieser nur seine 'Meinung' zu dem Fall abgibt, keine Fakten. Und dass andere Experten durchaus andere Meinungen haben können.

              Es gibt nur den Fakt, dass CM diese Line bestellt hat, und deshalb bedeutet das, dass CM sie auch verwendet hat? - Es gab nur diese Bestellung für ein vented set, und ein vented set ist notwendig, Propofol mit einem Spike verabreichen zu können.
              Die Gerichtsmediziner haben kein solches Set vor Ort gefunden, weiß er das? - Ja. Aber man kann es ja auch leicht entfernen.
              Es ist aber doch auch einfach, ein Fläschchen verschwinden zu lassen? - Ja. Aber das macht eine Beule in einer Tasche.
              Chernoff: ist es nicht auch einfach, eine Spritze verschwinden zu lassen? - Naja, es ist eine Nadel dran.
              Shafer hat eine 20cc Spritze zur Demonstration verwendet, CM hat aber eine 10cxc Spritze zu Protokoll gegeben. *- Shafer: für die Demonstration war das irellevant.
              Die Propofol-Flasche, die Shafer gestern verwendet hat, hat nicht die gleiche Größe wie die, die bei MJ gefunden wurde? - Korrekt.
              Wieso nimmt Shafer an, dass CM einen Schnitt in den Infusionsbeutel gemacht hat? - Weil das vor Ort so vorgefunden wurde.
              Das ist seine einzige Basis für diese Vermutung? - Ja.
              Dr. White hat Shafer Unterlagen zum Fall geschickt. Auch das Statement von Alberto Alvarez? - Ja.
              Shafers Bericht

              Chernoff zitiert: 'um zu verstehen, dass passiert sein könnte...'
              Hat Shafer jemals mit Alvarez gesprochen oder ihn getroffen etc.? - Nein.
              Shafer basierte seinen Bericht nicht nur auf der Zeugenaussage von Alvarez sondern auch darauf, dass dieser darin die Wahrheit sagt?- Ja.
              Deshalb hat er das der Jury so vorgeführt und gesagt, dass er sowas vorher noch nie gesehen hat? - Ja.
              Shafer sagte vorher, dass ein Mediziner keine gewagten Vermutungen anstellen soll, die nicht auf Fakten basieren. Aber würde er nicht auch meinen, dass er hier gewagte Vermutungen anstellt? - Überhaupt nicht.
              Weiß er, dass es sich hier um einen Criminal Trial handelt und nicht um malpractice? - Ja.
              Shafer will keine Bezahlung bei malpractice? - Korrekt.
              Wie oft musste er schon als Zeuge bei einem malpractice case aussagen? - Ein Mal.
              Shafers CV (=Lebenslauf)

              Stanford ist eine gute Uni? - Ja.
              Er war nie ein Student von Dr. White? - Korrekt.
              Dr. White war aber Assistant Professor an der Uni, als Shafer dort studierte? - Ja.
              1978 machte Shafer ein Praktikum. Besprach er das Praktikum vorher mit Dr. White? - Ja.
              Chernoff will aufzeigen, dass Shafer durch Vitamin B von White tolle Möglichkeiten bekam und zählt verschiedene gemeinsame Projekte auf.
              Shafer kennt Dr. White seit ca. 30 Jahren. Als Shafer vor 2 Tagen gefragt wurde, was er zu Dr. Whites Statement sagte ('MJ hätte Propofol auch trinken können'), sagte er, er sei 'enttäuscht'. Diskreditiert er Dr. White damit nicht? - Einspruch. Stattgegeben.
              Weil Anklage und Verteidigung nun die ganze Zeit durcheinander reden, ruft sie der Richter zu sich.

              Shafer hat vor einiger Zeit ausgesagt, dass selbst ein Student im ersten Jahr über die bioavailability von getrunkenem Propofol bescheid weiß. Trotzdem veranlasst Shafer eine Studie mit Menschen? Würden seine Studenten dann nicht sagen 'was für eine Zeitverschwendung'? - Daten sind immer wichtig. Es ist immer besser, auch Daten zu haben, anstatt einfach nur zu behaupten, dass Propofol der bioavailability nicht unterworfen ist. Er wollte durch die Erhebung der Daten nur aufzeigen, dass er recht hat.
              Shafer hat selbst einmal 20ml Propofol geschluckt? - Ja.
              Shafer wusste, was Dr. White vor Gericht aussagen würde? - Er wusste es nicht und weiß es jetzt immernoch nicht. (Er war ja noch nicht dran, Anm.)
              Simulationen bzgl. Propofol

              In seiner Simulation erhält MJ die erste Spritze um Mitternacht. Aber er hat doch die Statements gelesen und weiß, dass MJ um Mitternacht noch probte? - Shafer: es geht nicht um die Uhrzeit, es geht nur darum, zu zeigen, dass der Level, der bei MJ gefunden wurde, erreicht werden kann.
              Lorazepam ist kein Analgetikum? - Korrekt.
              Ein Analgetikum stoppt Schmerzen.
              Lorazepam ist ein Sedative.
              Wenn eine Person nicht auf äußere, schmerzhafte Einwirkungen reagiert, schläft die Person dann? - Ja.
              Shafer kann keine Aussagen dazu machen, wie MJ auf verschiedene Dosierungen reagiert hat/hätte. Da er schon länge Benzodiazepines zu sich genommen hat, kann er sich daran gewöhnt haben und dann anders reagieren.
              Warum hat Shafer 40mg für seine Simulation genommen? Heißt das, dass er behauptet, CM hätte MJ diese Menge verabreicht? - Es gab keinerlei medical records, aber eine Ampulle in der Größe wurde gefunden.
              Shafer hatte im ersten Entwurf seiner Simulationen eine weitere Linie 'painful stimulus' (regiert auf schmerzhafte Reize). Warum hat er sie für die Endversionen rausgenommen? - Shafer: Er versucht Laien schwierige Sachverhalte zu erklären, deshalb wollte er die Grafiken so einfach wie möglich halten.
              Er hat keine Simulation für oral eingenommenes Lorazepam präsentiert. Hat er das für die Anklage mal ausgerechnet? - Ja.
              Shafer: der Halbzeitwert von Lorazepam ist 22 Minuten. Die Tablette gelangt in die Leber. Bioavailablity um 90%. Das Medikament gelangt ins Blut, zirkuliert und verteilt sich in Gewebe. So gelangt es auch ins Gehirn. 25% des Metabolites gehen zurück in den Magen.
