A recent Boston.com story, “Jackson Doctor’s Legal Bills Issue in Texas Court” reports that an insurer for the doctor charged in Michael Jackson’s death has asked a judge to rule it is not responsible for the physician’s legal bills. Medicus Insurance Co. argues that Dr. Conrad Murray’s medical malpractice policy doesn’t cover his defense costs because the case stems from alleged criminal wrongdoing, according to documents filed in state court in Houston. Murray’s policy, which was purchased roughly a month before Jackson’s death in June 2009, did not cover incidents involving general anesthesia, the company argues.

Medicus, which is based in Austin, claims it is not required to defend Murray’s medical license in three states. The insurer argues that scrutiny by Texas and California officials came as a result of allegations of wrongdoing in Jackson’s death, and that Nevada attempted to suspend Murray’s medical license because he was behind on child support payments, not for his medical work.

The court filings do not indicate how much Murray’s defense in the various cases may cost. The company’s lawsuit states that Murray’s policy only covers the doctor’s actions in Texas. Medicus filed its case after Murray asked the insurers to pay for his defense in the California court case and medical board hearings in other states, according to the suit.

Murray entschied sich während seines Prozesses nicht auszusagen. Dagegen entschied er sich vor und während des Prozesses gegenüber den Medien Stellung zu beziehen.
Dort vermeldete er. "Ich fühle mich nicht schuldig, weil ich nichts falsch gemacht habe" Auf die Frage ob er vernachlässigend war als er MJ alleine ließ sagte er: Nein, Nein.
Seine Lügen an die Polizei erklärte er damit, dass diese nicht nach Telefonanrufen fragte und er dache dies sei nicht wichtig. Zudem beschuldigte er permanent das Opfer seinen eigenen Tod verursacht zu haben. Er ging in seinen Aussagen soweit zu sagen, dass er vom Opfer getäsucht wurde und stellte sich als jemand dar, der wegen des Betruges des Opfers Schaden erlitten hat.

Im Prozeß um den Leibarzt von Michael Jackson, Conrad Murray, fordert die Staatsanwaltschaft jetzt auch noch eine Geldstrafe für den Mediziner.

Los Angeles - Am 29. November wird vor Gericht das endgültige Strafmaß für Conrad Murray, den ehemaligen Leibarzt von Michael Jackson, verkündet, der für den Tod des „King of Pop“ vor zwei Jahren verantwortlich ist. Nun kann es sogar sein, dass zusätzlich zu der Freiheitsstrafe noch eine Geldstrafe von beachtlicher Höhe auf Murray zukommt.

Ginge es nach den Forderungen des Staatsanwaltes, müsste Murray nämlich zusätzlich zu seiner Freiheitsstrafe auch noch umgerechnet 75 Millionen Euro Entschädigung an Jacksons Kinder bezahlen. Das will das Nachrichtenportal „TMZ“ nun aus Dokumenten der Staatsanwaltschaft erfahren haben. Prince, Paris und Blanket, gelten vor dem Gesetz als Opfer und hätten ein Recht auf Entschädigung, da ihnen durch den Tod ihres Vaters nun auch noch sein Einkommen entgehe. Court documents filed by prosecutors say that Jackson's kids -- Prince Michael, Paris and Blanket -- are "entitled to wages or profits lost due to injury incurred by the victim," adding that prosecutors estimated Jackson would have made $100 million in revenue from his This is It tour.

"The defendant has displayed a complete lack of remorse for causing Michael Jackson's death," according to the court papers filed by Deputy District Attorneys David Walgren and Deborah Brazil.

"... Due to the actions and decisions of the defendant alone, justice requires the defendant be sentenced to state prison for four years, be ordered to pay appropriate restitution to Michael Jackson's children and be ordered to pay all requisite fines under the law," the prosecutors argue in the court papers.

Murray, 58, was convicted on November 7 over Jackson's death, from an overdose of the powerful anaesthetic propofol, on June 25, 2009. He is scheduled to be sentenced Tuesday by Los Angeles Superior Court Judge Michael Pastor.

Attorneys for Murray, however, contend in court papers that the doctor's "background and character" warrant a sentence of probation, not prison time.

"Many of his patients are elderly, and many reside in low-income, underserved communities," according to the court papers filed by defence attorneys Edward Chernoff, J. Michael Flanagan and Nareg Gourjian.

"Dr Murray has a long history of treating everyone who came to his clinic, whether or not they had insurance coverage or the funds to pay him."

During his trial, Murray admitted to having given Jackson a small amount of propofol to help him sleep, but not the massive amount of the drug found in his body on the day he died.

The lawyers of Conrad Murray, who is in jail for involuntary manslaughter in the death of Michael Jackson, have urged a Los Angeles judge to avoid sentencing the doctor to more time in prison, where they say he has been receiving death threats.

The prosecution team, led by David Walgren, want Murray to receive the maximum sentence of four years in prison and pay the singer's three children, Prince, Paris and Blanket, restitution costs that could total more than $100 million.

The 58-year-old Grenada-born cardiologist has been behind bars since he was convicted on November 7. Murray is due to be sentenced on November 29. (you can watch Conrad Murray's sentencing live here - at 8:30 a.m.) In addition to more prison time, he could also lose his medical license.

His attorneys filed a sentencing memorandum on Wednesday, November 23, just before the Thanksgiving holiday, urging the judge to give him "a sentence of probation with substantial community service as a means of repaying his debt to society."

"The court is urged to refrain from imposing further time in custody," it said. "Because he must be maintained in solitary confinement at all times out of concern for his safety due to the death threats received, the conditions of his confinement are not only very onerous to him personally, but are extremely costly and cumbersome to the jail."

"Were he a dangerous person, this would be viewed as a necessary expense, but he is not," it added. "The offense was not willful or intended. It was, in fact, the last thing in the world that Dr. Murray would ever want to happen to one of his patients. He is, by every account, immense sorrowful and remorseful."

Head defense lawyer Ed Chernoff had made a similar argument at the time of Murray's conviction but the judge agreed with Walgren's stance that the doctor should be taken into custody and denied bail.

However, recently-issued California regulations state that if Murray is given a jail sentence, he would serve his time at a county facilty rather than in state prison because involuntary manslaughter is not considered a violent offense. Also, the duration of a jail sentence would be cut in half.

Walgren and his fellow prosecutors stated in their own memorandum, also submitted on Wednesday, that Murray should be sent to "state prison for four years, be ordered to pay appropriate restitution to Michael Jackson's children and be ordered to pay all requisite fines under the law."

The prosecution team says Jackson was set to earn $100 million for his sold-out "This Is It" London concert series that he had prepared for before his 2009 death.

It also says the singer's funeral, memorial services and other associated expenditures cost more than $1.8 million. Murray should also be ordered to pay attorney fees, collection costs and any interest, at a rate of 10 percent, that accured since Jackson died.

CONRAD MURRAY CAN STILL BE 'SOURCE OF HEALING IN THE WORLD'

In their request, Murray's lawyers also cited the doctor's troubled upbringing and said he could still practice medicine in some way.

"Conrad Murray is a self-made man of humble origins," the defense attorney's sentencing memorandum reads. "He grew up in a Third World environment where most basic services, including health care, were beyond reach for his family. He walked to school barefoot his first two years. He did not live with his mother until he was 7 years old, and did not meet his natural father until he was 25."

"Yet from a very early age, he knew that he wanted to be a doctor," it adds. "Conrad Murray still has the knowledge, capacity and motivation to be a source of healing in the world. Through he will perhaps not again be a doctor qualified to make diagnoses, he could educate and counsel patients about heart care and disease prevention."

Despite recent reports, Murray has not said he wants to commit suicide while in jail, one his lawyers told OnTheRedCarpet.com earlier this month. A source close to the doctor had said beforehand that Murray was never placed on suicide watch, but was "devastated" and "shocked he's actually in jail."

A Los Angeles jury had deliberated the fate of Murray, who had treated Jackson at his home on the day he died, for a total of about eight and a half hours after a six-week trial. In his closing argument, Walgren remarked sarcastically, "Poor Conrad Murray," in an apparent mockery of the way the doctor's lawyers tried to portray him to the jury.

After the unanimous guilty verdict was read, Murray appeared stone-faced and a single squeal was heard inside the courtroom (watch video).

Another one of the doctor's lawyers, Michael Flanaghan, told OnTheRedCarpet.com's parent company, KABC Television after the verdict was read: "Well, certainly there'll be an appeal. I'm sympathetic for (the Jackson's family's) loss, a tremendous loss."

Autopsy results show that Jackson died at age 50 on June 25, 2009 from an overdose of propofol, a powerful anesthetic that the singer referred to as his "milk," and other sedatives. Murray had administered the drugs to Jackson in the hours before his death. The King of Pop had suffered a cardiac arrest at his rented Los Angeles home and was pronounced dead at a hospital.
The jurors are made up of seven men and five women (check out more details about them). One of them, Debbie Franklin, told ABC's "Good Morning America" that she and the other jurors believe Jackson would "absolutely" be alive today if not for Murray.

Nachdem er angefangen habe, für Jackson zu arbeiten, habe er sich verpflichtet gefühlt, bei ihm zu bleiben. Jackson habe ihn ständig an seiner Seite gewollt.
Der "King of Pop" war im Juni 2009 gestorben, nachdem Murray ihm ein Narkosepräparat als Schlafmittel gegeben hatte. Murray räumte auch ein, dass es ein Fehler gewesen sei, keine Aufzeichnungen aufbewahrt zu haben. Das sei aber "nicht ursächlich" für den Tod Jacksons.

In der Zeitspanne von einer Stunde und 40 Minuten, die zwischen dem Spritzen des Schlafmittels und dem Notruf vergingen, überprüfte Murray nach eigenen Angaben die Lebenszeichen des Musikers, bevor er für Telefongespräche ins Nachbarzimmer ging. LOS ANGELES — Prosecutors who depicted Michael Jackson’s doctor as remorseless for the superstar’s death urged a judge Wednesday to sentence him to four years in prison, while a defense lawyer said Dr. Conrad Murray is in a prison of self-punishment and should receive probation.

The opposing sentencing memos were filed in advance of Dr. Conrad Murray’s sentencing hearing Tuesday. He has been in jail since he was convicted Nov. 7 of involuntary manslaughter for Jackson’s fatal overdose of the anesthetic propofol.
Prosecutors David Walgren and Deborah Brazil wrote that Murray has shown no remorse for Jackson’s death and has placed blame on others, including Jackson himself. They cited a series of post-trial media interviews with Murray that they submitted to Superior Court Judge Michael Pastor on a DVD.
In one excerpt, Murray states, “I don’t feel guilty because I did not do anything wrong.”

“Finally, the defendant consistently blames the victim for his own death,” said the prosecution brief, “even going so far as to characterize himself as being ‘entrapped’ by the victim and as someone who suffered a ‘betrayal’ at the hands of the victim.”

Defense attorney Nareg Gourjian, citing letters of praise from Murray’s former patients, said: “There is no question that the death of his patient, Mr. Jackson, was unintentional and an enormous tragedy for everyone affected. Dr. Murray has been described as a changed, grief-stricken man, who walks around under a pall of sadness since the loss of his patient, Mr. Jackson.”

Gourjian said Murray will never stop punishing himself over Jackson’s loss and, “In effect, he will be serving a form of life sentence. However, the offense was not willful nor intended. ... He is, by every account, immensely sorrowful and remorseful.”

Murray was convicted after six weeks of testimony focusing on Murray’s administration of the drug propofol, an anesthetic not intended for treatment of insomnia or for home use. While Jackson was under the influence of the drug, Murray admitted leaving the room, prosecutors noted. They said he abandoned his patient when he was the most vulnerable.

In their memo, prosecutors said Murray “acted as an employee and as a drug dealer and completely corrupted the trust necessary in a proper doctor-patient relationship.”

Gourjian asked the judge to consider Murray’s humble beginnings in Trinidad and his lengthy career of doing good during his practice in Houston.

“The transgression for which he is to be judged should be viewed within the context of the larger life of which it is a part,” he said.

He also argued in his 45-page memo that current budgetary problems and overcrowding of prisons has made it necessary to release non-violent, non-dangerous offenders. “Dr. Murray is clearly such a defendant,” he said.

Gourjian noted that because of constant death threats, Murray must be kept in solitary confinement, which is expensive.

“Conrad Murray still has the knowledge, capacity and motivation to be a source of healing in the world,” Gourjian wrote. “Though he will perhaps not again be a doctor ... he could educate and counsel patients about heart care and disease prevention.” He suggested that as a form of community service by the doctor.

Prosecutors attached to their motion a statement of monetary losses because of Jackson’s death exceeding $100 million. They suggested that “appropriate restitution” from Murray be ordered for Jackson’s children.

Much media talk about CM's sentencing hearing next Tuesday. Here are some thoughts. Under CA law, invl mansl carries 2,3,or 4 years prison.
Under s.1170 of CA Penal Code, where there are 3 sentences specified judge must pick the middle one, unless aggravating or mitigating circs.Thus at the sentencing hearing, both sides will adduce evidence. Pros will argue aggravating circumstances looking for a 4 year sentence.The def will adduce mitigating evidence look to reduce the sentence as much as they can. CM has the right to be heard, but no right to xexam. So defence cannot x- examine any member of the Jackson family who gives evidence at CM's sentencing hearing. Letters etc are admissible.

Er kann doch seine tolle Doku einfach abspielen lassen, da war er sehr gesprächig,Michael hat ihn die Falle gelockt, armer Murray, na klar sind die anderen Schuld, Murray hat mit dem Tod von Michael nichts zu tun. Die Jury hat ihn völlig zu unrecht schuldig gesprochen.

Tja Vulcan, wie so oft im Leben, irgendwann ist immer das erste Mal.
Es war für CM seine erste intensive Begegnung mit Propofol. Er hatte es sich ja eigentl. auch nicht zugetraut damit korrekt umzugehen, denn warum sonst wollte er unbedingt Dr. Metzger überreden mit ihm zusammenzuarbeiten ???
Der hat abgelehnt u. CM in seiner Selbstüberschätzung u. Geldgeilheit, hat sich trotzdem auf diese tötliche Mission begeben.

Es nutzt nichts ständig irgendwelche andere Ausreden für ihn zu finden u. die Schuld dem großen Ungekannten zuschieben zu wollen, der wußte das Michael tot mehr wert als lebendig war , oder Michael selbst, oder dass, wenn nicht Murray, dann wäre es ein anderer Arzt gewesen...eine Argumentation, die ich sowieso nicht nachvollziehen kann
Stell dir vor, man würde bei jedem Unglück/Verbrechen mit dieser Ausrede kommen, nach dem Motto: stell dich nicht so an, wenn X dich nicht in der U-Bahn zusammengetreten hätte, wäre es halt Y gewesen, also laß ihn laufen.


Es waren 2 Menschen an diesem Unglück beteiligt:
Michael Jackson und Conrad Murray.
Letzterer soll/kann sich doch glücklich schätzen, denn er ist mit dem Leben davongekommen !

Irgendwas stinkt hier doch gewaltig gegen den Himmel. Ich kann den CM je länger desto weniger als "Täter" ernst nehmen. Der hat sich von A- Z so komplett inkompetent verhalten, dass es kaum zu glauben ist. Und man bedenke, dass es um sehr, sehr viel Zaster ging und wahrscheinlich einige Personen wussten, dass Michael tot mehr wert war als lebendig.

CM soll in den Knast, wenn auch nicht der Wahrheit willen, dann doch zu seinem eigenen Schutz (und für seine Inkompetenz). Zudem werde ich einfach das verdammte Gefühl nicht los, dass Murray noch mehr (zuviel) weiss, was seiner Gesundheit schaden könnte. Ist doch irgendwie komisch, dass ein Arzt, dem während seiner bisherigen Tätigkeit nie ein erwähnenswerter Fehler unterlaufen ist pötzlich zu blöd ist, einen Patienten unter Narkose zu überwachen und im Notfall zu reanimieren. Panik, Schock, akuter Hirnschwund? Ich weiss nicht...

Da steckt doch mehr dahinter...

Dem Kern der Aussage von Q. Jones muss ich wohl zustimmen. Michael in seiner Position hätte sich auch ein Meth-Labor inkl. Chemiker zulegen können. Hat er nicht, dafür aber einen Arzt, der seinen riskanten Anordnungen Folge leistete. CM wäre bestimmt nicht der einzige gewesen, der für Zaster die 5 gerde stehen lässt und mal beide Augen zudrückt. Ach Menschen, jeder hat doch seinen Preis...

Judge denies Jackson doc's bid for new testing

LOS ANGELES, CA -- A judge denied a request Monday by lawyers for the doctor convicted of causing Michael Jackson's death to have an independent laboratory test the contents of a key vial of evidence.

Just days before the scheduled sentencing of Dr. Conrad Murray, Superior Court Judge Michael Pastor said defense attorneys could have sought the testing months ago or even during the doctor's six-week trial but chose not to.

"You're not involved in fishing, you're involved in foraging," Pastor said.

Murray's attorneys wanted a lab to test a small amount of liquid found in a vial of the anesthetic propofol that authorities contend was used to help Jackson sleep on the day he died.

Defense lawyer J. Michael Flanagan argued the results would reveal the accuracy of a theory by a prosecution expert who testified that Murray left Jackson's bedside while the singer was on an IV drip of propofol and the painkiller lidocaine.

Murray had been giving Jackson nightly doses of propofol to help the singer sleep as he prepared for a series of comeback concerts.

Deputy District Attorney David Walgren contended there was no legal basis for the testing and said Murray received a fair trial.

Pastor examined the propofol vial, which was found in the closet of Jackson's bedroom, before issuing his ruling.

Flanagan said it didn't occur to him that the contents of the vial should be tested until after the conclusion of Murray's trial, which ended Nov. 7 with the conviction of the cardiologist on an involuntary manslaughter charge.

Flanagan said if prosecution expert Dr. Steven Shafer's theory is correct, the small amount of liquid that remained in the vial should contain lidocaine. In that case, "that's the ballgame" and would prove Murray did leave the singer alone on an IV drip, Flanagan said.

Flanagan also argued that Shafer didn't tell jurors that he believed Murray injected lidocaine into the propofol vial until Shafer was called as a rebuttal witness in the final moments of testimony.

Walgren said Shafer and other witnesses acknowledged that they didn't know exactly what happened in Jackson's bedroom before the singer's death on June 25, 2009. Shafer was one of several experts who told jurors that he could only theorize on events based on toxicology results, Murray's statements to police and evidence found at the scene.

"Whether there was lidocaine in that bottle or not is completely irrelevant," Walgren said.

Murray is set to be sentenced on Nov. 29. Walgren said he is finalizing work on a sentencing memorandum and several people may speak during the hearing. He did not say whether members of Jackson's family, several of whom attended the trial daily, would offer statements.

Murray remains jailed and faces a possible sentence ranging from probation to up to four years.
