Ich denke mir, nur ruhig Blut... der hat sowieso keine Chance seiner gerechten Strafe zu entgehen. Jetzt hat er erstmal nix mehr zu verlieren und probiert es eben nochmal. Aber eins muss man ihm lassen, hartnäckig ist er, man könnte glatt glauben, der denkt wirklich er ist unschuldig....anscheinend hat er sich da eine Scheinwelt aufgebaut, weil die Wirlichkeit so grausam ist. Die Schuld auf seinen Schultern ist schwer wie Blei. Und das ist gut so.

CM hat bei Gericht einen Antrag gestellt, dass man ihm doch einen Pflichtverteidiger zur Verfügung stelle möge, da er mittellos und nicht in der Lage sei einen solchen zu bezahlen.

Conrad Murray filed an amended notice of appeal in Los Angeles Superior Court on Tuesday stating that he is indigent and unable to pay for an appellate lawyer to try to overturn his involuntary manslaughter conviction.
The 58-year-old cardiologist intends to appeal his conviction but does not yet have an attorney who can prepare briefs and argue his case before the California 2nd District Court of Appeal.
The U.S. Supreme Court has ruled that felony convicts have a constitutional right to assistance of counsel.
A jury convicted Murray last month in connection with Jackson's June 2009 death. Murray is expected to serve roughly two years in jail.Kommentar

Conrad Murray Under Tight Security: Lawyer

The doctor convicted of killing Michael Jackson is coping with tight security and isolation and remains optimistic that he will win an upcoming appeal, his civil attorney said Tuesday.
Charles Peckham said sheriff's deputies appear to be subjecting Conrad Murray to more security than other inmates at Men's Central Jail and that the physician was left heavily shackled during their jailhouse meeting.
"Treating him like Hannibal Lecter is offensive," Peckham said, referring to the fictional serial killer from popular books and films. A sheriff's officials defended the security measures, saying they were for Murray's safety.
The attorney had to obtain a court order Tuesday to meet with Murray to discuss strategy on a wrongful death lawsuit filed by Jackson's father. Peckham said despite the judge's order, he was denied entry to the jail, but officials relented after speaking with the civil trial court handling the case.
He said their initial 30-minute meeting was cut short when the jail was placed in lockdown, but Peckham said the time was enough to upset him and see that Murray's fortunes had dramatically changed.
"This man who saved lives made a mistake, and they're going to him pay like a mass-murderer," Peckham said. The doctor spoke extensively to documentary filmmakers before his conviction, but few details of his life behind bars have been divulged.
Murray "is a real target because of his notoriety and because of the Michael Jackson connection," sheriff's spokesman Steve Whitmore said. "We're just being extra cautious right now."
He said jail officials will evaluate how to handle Murray's incarceration, but that he may not serve his whole sentence in isolation from other inmates. He noted that without a recent change in state law, Murray would be serving his term in state prison, not a county lockup.
Peckham said Murray, who has been jailed since a jury convicted him of involuntary manslaughter on Nov. 7, is optimistic that an appellate court will grant an appeal on the case.
Peckham's visit came hours after the physician, who was never paid the $150,000 a month he expected for serving as Jackson's personal physician, asked a court to provide a publicly funded attorney to handle his appeal because he is indigent.
J. Michael Flanagan, who was one of Murray's criminal defense lawyers, agreed with Peckham's description. He said that when he visited Murray recently, four deputies escorted the physician into the meeting room and shackled him to a table.
"He can't even scratch his nose," the attorney said. Flanagan said he saw another inmate who was charged with murder meet with his attorney without the same restrictive measures.
"This is because of his notoriety," Whitmore said. "It's not so much the crime itself."
Peckham said he didn't "think the sheriff's department is being anything but professional. I do however believe the amount of security for Dr. Murray is vastly out of proportion with the potential threat."
He said Murray told him he appreciates the support and prayers he's received from former patients and friends.
In the early days of his confinement, Murray was classified as suicidal in jail records, according to a probation report. Peckham said he saw no indications that the physician intended to take his own life and that he seemed to be in control of his mental health.
Murray indicated in a two-page court filing Tuesday that he would rely on a court-funded attorney to help craft his appeal. The U.S. Supreme Court has ruled that felony convicts have a constitutional right to assistance of counsel.
Flanagan and Murray's other criminal attorneys had sought to present evidence to jurors about Jackson's finances, details of his deal for a series of comeback concerts, and information about other doctors treating the pop superstar. But the judge refused and ruled the trial would be about Murray's care of the singer.
The Houston-based doctor had been giving Jackson nightly doses of the powerful anesthetic propofol as a sleep aid. The drug is normally given in hospital settings with extensive monitoring equipment, but testimony showed Murray had only basic equipment and left Jackson's bedside on the morning of his death.
Pastor has scheduled a hearing for Jan. 23 to decide whether to order Murray to pay any restitution to Jackson's family or reimburse them for funeral expenses, which totaled more than $1.8 million.
Jackson's estate estimated the singer would have earned at least $100 million if he had performed his "This Is It" concerts planned for London's O2 arena.
Murray will lose his medical license as a result of the conviction is upheld.

Der Richter fügte dem Urteil hinzu, dass er den Schuldigen nicht in ein Staatsgefängnis überstellen könne, weil einer neue Regelung der kalifornischen Gesetzgebung dies nicht mehr ermögliche.
Das Strafmaß halbiert sich automatisch und es besteht für Murray die Möglichkeit, die Haft in Hausarrest umzuwandeln, weil er kein Gewaltverbrechen begangen hat.
Er könnte schon in den nächsten Wochen aus dem Gefängnis entlassen werden und es könnte sogar sein, dass Dr. Conrad Murray schon an Weihnachten wieder nach Hause kann, um den Rest seiner Strafe zu Hause abzusitzen.

Conrad Murray war am Dienstag von einem Gericht in Los Angeles zur Höchststrafe von vier Jahren verurteilt worden. Laut der Webseite «Tmz.com» soll Murray ein Schriftstück eingereicht haben, in dem er Einsicht in Gerichtsunterlagen und Protokolle des Falles fordert. Das spricht dafür, dass er in Berufung gehen will.

Murray braucht wohl einen Pflichtverteidiger,(den zahlt dann der Staat) weil er sich einen Anwalt für das Berufungsverfahren nicht leisten kann.Kommentar

.... das "der Fall" an sich schon vorher klar war und Murray obsiegen wird.
Nun denn.
Da Murray anscheinend nicht nur medizinisch sondern auch jurisitisch sehr bewandert zu sein scheint, zieht er es vor sich selbst verteidigen.
Das verbessert seine Chancen ungemein. Schließlich verhauen selbst Staranwälte so was schon mal.
Hat meistens einen Grund.
Eine Verteidigung, eine Berufung ist erst mal immer nur so gut, wie das, was man überhaupt in der Hand hat. Irgendwann kann es auch kein Anwalt mehr wirklich retten. So sieht es jedenfalls der Strafrechtler. Anwälte selbstredend anders.
Sorry..... aber wirklich ernst nehmen kann man das selbst mit allem Ernst nicht mehr so ganz.Kommentar

Ich setz das mal aus dem anderen Murray-Thread hier rein, damit wir hier auf dem aktuellen Stand sind:
Anscheinend hat Murray immer noch kein Einsehen seiner Schuld und macht weiterhin Michael für seinen Tod selbst verantwortlich.
Er glaubt/hofft auf den Erfolg seines Berufungsverfahrens und bittet um Haftunterbrechung/Haftverschonung bis zu dessen Abschluss, um arbeiten und seine 7 Kinder ernähren zu können.
Eine Anhörung zu seinem Gesuch ist für den 24.2.2012 anberaumt.

A hearing on the motion was set for Feb. 24.

Walgran/Brazil haben einen Antrag gestellt Murray´s Haftverschonungsantrag nicht zuzustimmen. Murray sei weiterhin eine Gefahr für die Allgemenheit, es besteht Fluchtgefahr, nach dem Entzug seiner Lizenzen bindet ihn nichts mehr. Murray zeige weiterhin keinerlei Einsicht und Reue in seine kriminellen Handlungen, die den Tod von MJ verursachten. Daher soll er die Höchststrafe wie vorgesehen absitzen (wobei eine Umwandlung in Hausarrest nach 2 Jahren ohnehin wahrscheinlich ist). Über die Anträge der beiden Partein findet am Freitag ein Termin statt.

LOS ANGELES, Feb 21 (Reuters) - Michael Jackson's doctor should not be freed pending an appeal of his involuntary manslaughter conviction because he is a flight risk and has shown no remorse for his part in the singer's death, prosecutors argued in court papers on Tuesday.
The attorneys said Dr. Conrad Murray, who is serving four years in jail, should be denied his bid for freedom at a Los Angeles court hearing set for Friday.
Prosecutors David Walgren and Deborah Brazil said there was "complete uncertainty" over whether Murray would remain in California or flee if allowed out on bail.
"Based on his failure to accept responsibility for the decisions he made, his complete lack of remorse and lack of insight into the danger of his criminally negligent conduct, he remains a danger to the community," they added.
Murray was held criminally negligent in the June 2009 death of the "Thriller" singer after admitting giving him the powerful anesthetic propofol and sedatives as a sleep aid. He did not testify at trial and denied culpability.
Murray asked in January to be released on bail or put under house arrest until his appeal is heard, saying that a hearing could take over a year.

Der kommt mit einer Berufung nicht weit. Ich denke die werden ihn einsperren für das was er getan hat. Man kann so ein Typ nicht frei rumlaufen lassen. Nein er gehört weggesperrt. So ist es halt.

22.02.2012: Staatsanwaltschaft kontert Murrays Antrag
Wie am 29.1. hier berichtet, hatte Conrad Murray kürzlich den Antrag auf frühzeitige Entlassung gestellt. David Walgren und Deborah Brazil haben gestern für die Staatsanwaltschaft Stellung dazu zu genommen und argumentiert, dass Murray rechtmässig zu vier Jahren Gefängnis verurteilt wurde. Zudem bilde Murray eine Gefahr für die Gesellschaft und es bestünde Fluchtgefahr, wenn er auf Kaution entlassen würde. "Da [Conrad Murray] für seine Entscheidungen keinerlei Verantwortung übernommen hat und er keinerlei Reue gezeigt hat, was die Gefahr seines strafrechtlich fahrlässigen Verhaltens anbelangt, bleibt er eine Gefahr für die Gesellschaft", so die Staatsanwaltschaft in ihrer schriftlichen Stellungnahme. Es wurde auch festgehalten, dass Conrad Murray zahlreiche Kontakte ausserhalb des Staates Kalifornien und ausserhalb des Landes habe und, wenn freigesetzt, bestünde akute Fluchtgefahr. Zudem habe Murray in seinem Antrag keine substantiellen Rechtsfragen aufgebracht, die zur Aufhebung des Urteils führen könnten. Die Staatsanwaltschaft bemerkte auch, dass es unwahrscheinlich sei, dass Murray am Ende mehr als die Hälfte seiner Haftstrafe (d.h. mehr als zwei Jahre) absitzen müsse. Eine Anhörung zum Antrag der Staatsanwaltschaft wurde auf den Freitag angesetzt. Es wird angenommen, dass die Behandlung von Conrad Murrays Antrag aus gerichtsprozesslichen Gründen über ein Jahr in Anspruch nehmen könnte.
